CVS Pharmacy has agreed to pay $2.35 million to settle a wage and hour class action lawsuit alleging that the company did not pay pharmacists for overtime.
The CVS wage and hour class action lawsuit alleges that CVS pharmacists within California’s Region 73 worked more than six consecutive days without being paid overtime compensation over the last five years.
Lead plaintiff Rimanpreet Uppal filed the CVS class action lawsuit based on alleged violations of California labor laws including: unpaid overtime, failure to provide accurate itemized statements, and unfair business practices. Uppal claims that pharmacists who work more than six days in a row are entitled to overtime pay for work beyond the sixth day, regardless of how CVS defines its work week.
In addition to this CVS unpaid overtime class action lawsuit, the pharmacy has agreed to settle four other related cases with similar allegations including:
- Timothy J. Connell v. CVS Pharmacy, Inc., et al., Los Angeles Superior Court Case No. BC523172 (Region 65)
- Klara Paksy v. CVS Pharmacy, Inc., et al., Los Angeles Superior Court Case No. BC523491 (Region 54)
- Dale Bystrom v. CVS Pharmacy, Inc., et al., Los Angeles Superior Court Case No. BC525991 (Region 74)
- Angil Sharobiem v. CVS Pharmacy, Inc., et al., U.S. District Court (C.D. Cal.) Case No. 2:13-CV-9426-GHK (Region 60)
CVS claims that all of these wage and hour lawsuits are without merit and denies any wrongdoing. However, the company has agreed to settle in order to avoid further litigation.
Who’s Eligible
The CVS class action lawsuit settlement is open to all Class Members who are or were employed by CVS as non-exempt pharmacists in Region 73 in the State of California. Class Members must have worked more than six consecutive days without overtime pay from March 27, 2010 through April 30, 2015.
Potential Award
Varies.
The Settlement Administrator will calculate the number of occurrences (compensable workweeks) for all Class Members based on the data provided by CVS. Then the total settlement amount of $2,350,800 will be divided among all qualifying Class Members.
Proof of Purchase
CVS class action settlement Class Members do not have to provide proof of purchase. If you qualify to receive financial compensation a Claim Form will be sent to you.
