Allstate insurance has agreed to settle a class action lawsuit stemming over allegations that the insurance company (and its affiliates) did not properly adjust or settle car accident bodily injury insurance claims in Montana, with people who did not hire a lawyer to help them settle their claim.
The Allstate insurance class action lawsuit alleged that those Class Members who did not hire a lawyer to settle their bodily injury claim did not have a fair Allstate settlement. Under the Allstate class action settlement, Class Members may request to have their bodily injury claims re-opened and re-evaluated to determine if they are owed an additional payment.
Allstate insurance Class Members can also settle for a fixed cash payment if they don’t want their case re-adjusted. Current and former employees of Allstate are excluded from the Class.
Allstate denies the accusations by claiming that they properly adjusted and settled claims. However, the insurance company has agreed to the Allstate class action lawsuit settlement in order to avoid the cost of further litigation.
Who’s Eligible
The Allstate class action lawsuit is open to all Class Members who made a bodily injury claim to Allstate (or an affiliated company) due to a motor vehicle accident that occurred in Montana or involved an Allstate policy issued in Montana.
Class Members also include those individuals who had their class settled and paid for by Allstate for less than the applicable policy limits during the period July 1, 1995 to June 15, 2015.
In addition, Allstate Class Members must not have hired a lawyer to help settle their bodily injury claim and they must not have been a Class Member in either Tyler Dempsey, et al. v. Allstate Insurance Company, Butte County, Montana, Case No. CV-03066-BU-SEII or Alberto Cazares, et al. v. Allstate Ins. Co., et al., Miller County, Arkansas, Case No. CV-2009-72-3.
Potential Award
$200 – $650.
Those Class Members who settled their bodily injury claims for $1,000 or less can choose to settle for a fixed payment. If you settled for less than $500, you can get a fixed payment of $200; if you settled for $500-$1,000, you can get a fixed payment of $650.
Class Members who are requesting a re-adjustment of their original claim will have their case reviewed by a retired Allstate adjuster who may agree to an additional payment.
Proof of Purchase
The Allstate insurance class action lawsuit does not require any additional documentation to have your claim re-adjusted. However, Class Members who provide documentation will help aid in the process.
Class Members who have no additional documents to provide will rely on the documentation that already exists in their claim file.

Allstate is Horrible and will lie and cheat you every chance they get on your claim. Also never buy insurance from AIG, 21st Century insurance, The Hartford, Mercury, National Grange, Frontlind Homeowners also known as First Protective, Geico, State Farm, Nationwide, USAA, Esurance also owned by Allstate, Progressive and Farmers
We are having the same problem with The Hartford right now. This must be common practice for automobile insurance companies. They have learned from each other that they can get away with not paying bodily injury claims resulting from car accidents.
