A settlement has been reached in a class action lawsuit involving uninsured and underinsured motorist (UM/UIM) coverage on car insurance policies issued by, renewed by or in effect with Safeco Insurance Company of America. If you were insured under any New Mexico Safeco policy issued in New Mexico and effective between May 20, 2004 and Nov. 1, 2014 that did not provide equal limits UM/UIM coverage, you may be eligible for benefits from this class action settlement.
The Safeco class action lawsuit alleges Safeco’s UM/UIM selection or rejection forms that were used from May 20, 2004 and Nov. 1, 2014 were invalid with respect to selection of uninsured/underinsured motorist coverage in amounts less than liability coverage limits or rejection of UM/UIM coverage altogether.
According to the Safeco class action lawsuit, Safeco’s insurance policies should be reformed to provide UM/UIM limits equal to the policy’s liability limits, and people who were insured by Safeco and had accidents caused by uninsured or underinsured motorists during the Class Period (May 20, 2004 through Nov. 1, 2014) should be entitled to have their claims adjusted or readjusted to the reformed UM/UIM coverage limits.
Safeco denies any wrongdoing but agreed to settle the insurance coverage class action lawsuit to avoid the cost, uncertainty and delay of litigation.
Who’s Eligible
Class Members of the Safeco class action settlement include anyone who was insured under any New Mexico Safeco policy issued in New Mexico and effective during the Class Period of May 20, 2004 to Nov. 1, 2014, that did not or does not provide equal limits UM/UIM coverage.
You do not have to have had an accident with an uninsured or underinsured motorist to be a Class Member of the Safeco settlement.
The Safeco class action settlement creates two different categories of Subclass Members:
- Subclass A Members, who have not had any accidents and are entitled to only policy reformation; and
- Subclass B Members, who have had accidents and can make claims for a settlement payment.
Potential Award
Varies. Subclass B Members who submit timely and valid Claim Forms may be eligible to receive payment from the Safeco class action settlement.
The amount of the payment will depend on a number of factors, including the terms of the applicable Safeco policy, the cause and extend of the bodily injury and/or property damage, the equal limits UM/UIM coverage available on your Safeco policy, any prior payments of UM/UIM benefits you may have already received in the accident, and various discounts that may be applied.

Members of Subclass AÂ are not entitled to monetary benefits and do not need to submit a Claim Form.
Class Members who wish to opt-in to Subclass B must do so no later than Oct. 7, 2015.
