School bus transportation providers Student Transportation of America Inc., Santa Barbara Transportation Corp., A&B Bus Co. and Mission School Transportation Inc. have reached a class action settlement agreement over claims they violated California wage and hour laws.
If you worked for the defendants in California as a non-exempt hourly employee between 2008 and 2015, you may receive a class action settlement.
Plaintiffs in the class action lawsuit (Alegria, et al. v. Student Transportation of America Inc., et al.) allege the companies failed to pay all wages including minimum wages and overtime wages, failed to provide proper meal periods and rest breaks, failed to provide legally compliant itemized wage statements, failed to maintain accurate records required by state law, failed to pay all wages upon termination, failed to pay wages for split shifts, failed to pay reporting time wages, and failed to reimburse employees for job-related expenses.
The defendants deny any wrongdoing but agreed to settle the wage and hour class action lawsuit to avoid the expense and uncertainty of going to trial.
A California federal judge preliminarily approved the agreement on June 26, 2015. A Final Fairness Hearing will be held November 17.
Who’s Eligible
Class Members of the Student Transportation class action lawsuit include all current and former non-exempt employees of the defendants who were employed at any time between June 28, 2008 through June 26, 2015.
Potential Award
Varies. Settlement awards paid to Class Members will be calculated based on “work weeks” worked during the Class Period (June 28, 2008 through June 26, 2015). The total work weeks for all Class Members will then be added together, and the Net Settlement Amount left over after the deduction of Settlement Administration Costs, Attorneys Fees , and Incentive Awards will be divided by that total work week number to obtain a “weekly amount.”
It is estimated that Class Members will be paid anywhere from $2.14 to $781.77, with an average payout of approximately $273.68.
Claim Form Deadline
There is no claims filing process for the school transportation class action settlement. All Class Members will be automatically included and mailed a settlement award if the agreement is approved, and provided that the Class Member has not opted out.
The deadline to exclude yourself is Oct. 5, 2015.
