First American Title Insurance

The Talon Group, a division of First American Title Insurance Co., has agreed to settle a class action lawsuit alleging the company improperly charged certain fees when it served as the escrow agent for real estate transactions. If you paid a wire/express fee, reconveyance fee and/or recording fees to Talon in a Washington real estate transaction that closed between Aug. 18, 2003 and Dec. 16, 2013, you could be entitled to benefits from the class action settlement.

Who’s Eligible

Class Members of the Talon Group escrow fee settlement include anyone who paid a wire/express fee, reconveyance fee and/or recording fees to Talon in a Washington real estate transaction that closed between Aug. 18, 2003 and Dec. 16, 2013.

Potential Award

Varies. The parties have agreed to a class action settlement that will provide a monetary award to each Class Member for the wire/express, reconveyance and recording fees they paid, up to a total of $1,275,000. In addition, Class Members who seek to recover reconveyance fees will receive a coupon for $50 toward future escrow services from First American Title Insurance.

Proof of Purchase

None. The Settlement Administrator will review each Claim Form and determine its validity.

Case Summary

On Aug. 18, 2009, plaintiff Karen Tavenner filed a class action lawsuit accusing Talon of improperly charging her and other customers wire/express fees, reconveyance fees and recording fees when it served as the escrow agent for real estate transactions since Aug. 18, 2003. Talon denies the allegations but agreed to a class action settlement to avoid the expense and uncertainty of trial.
