A $350,000 class action settlement was reached with Charming Charlie and customers in California, who claim the retailer requested and recorded the personal information of its customers during the course of their transactions, in violation of California law.

If you made purchases with a credit card at a Charming Charlie store in California from July 9, 2013 through July 29, 2015, and the clerk asked for and recorded your personal identification information as part of the transaction, you may qualify to benefit from this class action settlement.

Class Members will receive vouchers from the $350,000 class action settlement that may be used to purchase items at Charming Charlie stores.

This Charming Charlie class action lawsuit was filed in July 2014 in a California Superior Court by plaintiffs Heidi Anderson-Butler and Paul Haug, alleging that Charming Charlie requested their personal identification information, such as their addresses or telephone numbers, while making a purchase with a credit card at a Charming Charlie store in California. The lawsuit was later transferred to a federal court.

Butler and Haug claim that that their information was requested while they were making purchases with their credit cards, and that it was required by Charming Charlie to provide that information in order to complete their transactions.

They charged Charming Charlie with violating California’s Song-Beverly Credit Card Act of 1971, which prohibits such information from being collected as part of a credit card transaction.

Charming Charlie denies any wrongdoing but agreed to this class action settlement to avoid the cost and risk of trial. U.S. District Judge U.S. District Judge William B Shubb granted preliminary approval to this class action settlement on July 29.

Who’s Eligible

This class action settlement is for “all persons who, between July 9, 2013 and July 29, 2015, engaged in a credit card transaction at a California Charming Charlie Store and whose Personal Identification Information was requested and recorded by Charming Charlie at the Charming Charlie Store for purposes other than shipping, delivery or special orders. Also excluded from the Class are Defendant’s Counsel, Defendant’s officers and directors, and the judge presiding over the Action.”

Potential Award

Class Members will receive a voucher redeemable for Charlie Charming merchandise. The amount of the vouchers will depend on how many claims are filed.

UPDATE: On Jan. 7, 2016, readers began reporting that they were receiving vouchers worth about $25 from the Charming Charlie class action settlement.

Proof of Purchase

No proof of purchase is necessary. Class Members will need to fill out a claim form in order to benefit from this class action settlement. Class Members may be asked to provide supporting documents, such as receipts or credit card statements later on in the process.

    i just recieved my voucher today as well, for $25.92. i tried to use it online, and it will not take it. you have to use it in a store. i live in ohio now, so i am not sure if i will be able to use it or not (if it has to be a Cali store) ughh. sad!!

      I wrote an email to the email address on the voucher concerning the issue I had with trying to redeem the voucher in the store, (Charming Charlie) while I was ready to check out with my purchase the manager gave me a hard time redeeming the voucher, I wrote to the email address on the voucher because it stated if I had a bad experience or any other issues to email them, so I did and I have not gotten a reply back, but I couldnt use the voucher it is no good to me– because the manager in the store mentioned that I have to have a account set up for this purchase they gave me a hard time asking for my email address and or phone number associated with this voucher, I could not remember my email nor my phone/cell number back in 2014-2015. I have had my my identity stolen and had to change everything from email address to cell/phone numbers. So I left everything there and was totally humiliated because they were rude and were talking behind my back, rolling there eyes at me and such, it was such a rude behavior and no reason for all that. So How do I contact someone concerning this issue? I cant use the voucher….please respond back A.S.A.P. Thank you
