If you purchased or leased a new or used motor vehicle from a Koons dealership in Maryland from October 31, 2000 through July 10, 2008, you may be able to receive as much as $250 from a proposed class action lawsuit settlement.
According to the Koons class action lawsuit, several Koons dealerships overcharged customers between $25 and $95 for title, tax and registration charges, in violation of Maryland law. The class action also names Ford Credit Co. as a defendant, which financed at least 5,790 of the retail installment contracts or leases that were originated and then assigned by Koons. Both Koons and Ford Credit deny they violated any law but have chosen to settle the case to avoid ongoing litigation.
You’re considered a class member of the Koons dealership settlement if you purchased or leased a new or used vehicle from any of the following dealerships during the class period and paid the dealership for Governmental Charges as part of the transaction:
Koons of Marlow Heights
Koons Pontiac
Koons Buick
Koons GMC
Koons Mazda
Koons VS
Koons Suzuki
Koons Daewood
There are two settlement classes you can belong to:
The Overcharge Class includes all Koons dealership customers who during the class period (1) purchased or leased a new or used vehicle from one of the Koons dealerships listed above, and (2) as part of the transaction paid more to the Koons dealership for Governmental Charges than the amount which the dealership paid to the government for those charges. Members of the Overcharge Class who submit a valid claim will receive a cash payment of up to $75, minus a proportionate share of the litigation costs.
The Ford Credit Class includes all Koons dealership customers who meet the same requirements above but who also financed all or part of their vehicle transaction through a retail installment contract or lease which the dealership assigned to Ford Credit. Members of the Ford Credit Class will receive $250 minus a proportionate share of the litigation costs. You DO NOT need to submit a claim form if you belong to this class and received a notice in the mail.
If you did not receive a notice in the mail or if you purchased more than one vehicle from a Koons dealership during the Class Period and not all of the vehicles were financed through Ford Credit Co., you must submit a claim form to receive your cash reimbursement from the Koons class action settlement. All claim forms must be postmarked on or before the date of the Final Approval Hearing currently scheduled for April 7, 2011.
