Fifth Third Bank Overdraft Fee Settlement

Fifth Third BankFifth Third Bank has agreed to a $9.5 million settlement of a class action lawsuit concerning the way it issued overdraft fees. If you paid overdraft fees related to a Fifth Third debit card, check card and/or bank card, you could receive up to three times the amount you were charged from the class action settlement.

 

According to the Fifth Third class action lawsuit, Fifth Third Bank posted debit card transactions and/or ATM withdrawals in non-chronological order so that the bank could maximize the number of overdraft fees it charged to customers who had insufficient funds. Fifth Third Bank denies any wrongdoing, but has agreed to establish a $9.5 million settlement fund to settle the case, entitled Schulte v. Fifth Third Bank.

 

If you had a Fifth Third bank account at any time between October 21, 2004 and July 1, 2010, and incurred at least one overdraft fee as a result of the “re-sequencing” of at least one Fifth Third debit card transaction in non-chronological order, you’re considered a member of the settlement class and eligible to receive a cash payment from the Fifth Third overdraft fee settlement.

 

As part of the Fifth Third overdraft class action settlement, class members who submit valid claim forms by the deadline of May 2, 2011 will be eligible to receive up to three times the amount of overdraft fees they claim they were charged, depending on the total amount of valid claims submitted. If you do not have all of your bank records to support your claim, and your claim is based only on your best knowledge and belief, Fifth Third has the right to contest your claim. Claim forms can be downloaded or submitted online at the Fifth Third Overdraft Settlement Administrator website: www.overdraftsettlement.com.

    In 3 months I have paid almost $700 in overdraft and bank fees. It’s crazy they can do that still, after a class action suit, wow. At least half are from pending fees so it’s bullshit and they put them in any order to charge the most. I am going to close my account. I remember why I stopped using that bank lat time

      They still hit me the same way I’ve paid out like 900 in the last four months… then to top it off these worthless crooks paid me $2.03 cents from the settlement that proves they are still doing wrong got a payment this morning, I’m going to close my account and wish we could sue again…..

      I’m going through the same shit with them after telling them to BLOCK my card from overdrafts, but no , I got mentally sick and have paperwork to show them but they still giving me the run a round about a return credit for 703.28 and the morons tell me they can’t find it and I have the email that it was send direct deposit!!!!
      Mmmmm? What’s going on with them .
      I’m tired of it ,I have all my stuff ready to battle them in court!!!!
      AND THE SELL ” YOU’RE A VALUED CUSTOMER” WHAT A FXXXING JOKE!!!!!

        They charged me $222 in less than 7days which are including weekends. It’s ridiculous how much they charged for overdraft fees not to mention their transactions are out of sequence.

          I am going thru the same thing, I was just told that if I have overdraft coverage turned off I will still be charged overdraft fees if items are pending. They are full of shit I’m so tired

            Between February and April 2023 fifth third Bank has charged me over $525 an overdraft fee and overdrafted on my overdraft fees due in one account while I had money positive in another account. Time for a class action suit. They knowingly abuse my account I transferred money from social security to my debit account so I can go shopping $350 bucks going to overdraft fees without my being notified and yes I was in the hospital for some time and had problems with a Walmart series of phones. Always had money in my social security account they overdrafted fees due from overdraft charges. Class action suit time.

            I have been going through the same exact thing fighting with them constantly: I’ve called. Done the online chat and went to different branches and they all give me a stupid look and tell me they don’t know what’s going on.

    I was reported to credit bureau for missing a $1.50 balance for 2 months. Had no clue. Saw credit ding of 87 points and called cc. 53 and they refunded $40 But did not tell me that I had been charged $29 the month before for the same $1.50. I am 72 year old single working lady trying to survive and my credit score was 815. Recently I was in a doctors office and she was trying to convince me to get beast surgery for a growth. I asked how much it would cost and told her I could not afford it that my credit score was more important than my life,,,and I got off work at 6 tonight only to have this happen. Help me Jesus. Please let me sleep. I have a big work week coming up and look forward to Christmas day only to sleep

    They had my account in collection since 2011 affecting my credit badly. It was a secured credit card for $300 and they did not apply my $300 to my debt having me
    In collections for 7 years.
    They ruined my credit…

    These banks are out of control!!!! Now that banks are automated, they istantly take money out of accounts yet when putting money in, they do not do it instantly!!! Which is playing with my $ and causing overdrafts. I live off of $730 a month and they take and take!!! I am done with banking!!!!! Will be cheaper to get a prepaid debit card each month than to keep giving to them!!!! The big guys need to be aware of who they are hurting! They just stole my kids Christmas by fudging times that items came to the bank!

    This bank is not reputable at all. I recently just opened up a new business account because they were offering a $400 Bonus. The bank rep intentionally set the account up incorrectly with the wrong $ amount in the account so I would not qualify for the bonus. They also charge a $50 fee to close an account. Never heard of such a thing. Other banks do not charge you to close an account.

    They are still doing it. Does anyone have a copy of the Settlement Agreement to see if as part of the settlement, they would no longer engage in that conduct?

    I just got a check today and I never even knew about this class action suit. Definitely glad they got what they deserved! I remember everything they did like it was yesterday, gosh still makes me so mad. So this isn’t a scam check because the suit is 3 years old..?
