California Automobile Antitrust Class Action

car dealershipA class action lawsuit against several major automakers, including General Motors, Saab, Saturn, DaimlerChrysler, Ford, Volvo, Honda, Toyota and Nissan, could affect thousands of California residents. If you currently reside in California and purchased or leased a new motor vehicle manufactured or distributed by one of the defendants from an authorized dealer located in California between 2001 and 2003, you could be eligible to receive money if you choose to remain a member of the California Automobile Antitrust class action lawsuit.

 

Starting in 2003, numerous lawsuits were filed across the country in state and federal courts alleging that many of the largest automakers and certain trade associations (including National Automobile Dealers Association and Canadian Automobile Dealers Association) conspired together to restrict the export of cheaper Canadian vehicles into the United States. As a result, plaintiffs alleged that U.S. consumers paid higher prices for new vehicles during this period than they would have otherwise paid had the defendants not coordinated this conduct.

 

Several of the lawsuits were consolidated into a single class action lawsuit, entitled Automobile Antitrust Cases I, II, for the California consumer class. A separate federal class action, entitled Canadian Export Antitrust, is also pending. Two of the defendants in that case, Toyota and Canadian Automobile Dealers Association (CADA), have reached a settlement that, if approved, could result in cash refunds to anyone in the United States who purchased a new motor vehicle between January 1, 2001 and April 30, 2003. To be considered a class member of the California Automobile Antitrust class action lawsuit, you must be a current California resident who purchased or leased one the following brands of cars, SUVs or light-duty trucks from a California authorized dealer between January 1, 2001 and April 30, 2003:

 

Acura

Buick

Cadillac

Chevrolet

Chrysler

Dodge

Ford

GMC

Honda

Hummer

Infiniti

Jaguar

Jeep

Land Rover

Lexus

Lincoln

Mazda

Mercury

Nissan

Oldsmobile

Plymouth

Pontiac

Saab

Saturn

Toyota

Volvo

 

If you fit the above description, you have a choice of whether or not to remain a member of the California Automobile Antitrust class. If you choose to remain a member of the class, you do not have to do anything at this time. By remaining a class member, you give up your right to sue the defendants individually, but you will be able to receive a portion of any of the settlement benefits if a class action settlement is reached. If you wish to exclude yourself from the California Automobile Antitrust class action lawsuit, you must mail your request for exclusion postmarked no later than January 14, 2011.
