A Washington, D.C., woman who used talcum powder for years as part of her personal hygiene routine recently filed a lawsuit against Colgate-Palmolive after she was diagnosed with mesothelioma.
Plaintiff Doris J. alleges the Colgate-Palmolive product she used contained asbestos, which caused her to develop mesothelioma, cancer of the mucus membrane surrounding the lungs.
According to the lawsuit, Doris was exposed to asbestos from using Colgate-Palmolive’s Cashmere Bouquet Talc Powder from the 1950s to the 1990s. The lawsuit says she had no reason to know it contained asbestos. She says she first learned of the connection after her diagnosis in November 2014.
Doris’ lawsuit accuses the company of failing to warn her about the dangers of its product, and for negligent asbestos exposure. Similar to asbestos fibers released into the air during construction, these talc particles would implant themselves inside the patient and remain there for years before causing problems.
Although this case involves damage to the lungs, talc powder has been alleged to cause ovarian cancer in women. When women use talcum powder in their genital area, the particles sometimes enter their bloodstream, traveling through their fallopian tubes, ending up in their ovaries.
Doris’ physicians say the asbestos fibers most likely implanted themselves into her lung cavity for years before she showed any symptoms. It can take decades after exposure for asbestos lung cancer or mesothelioma to appear.
The lawsuit asserts Colgate-Palmolive neglected to warn consumers of the risks of using the product. Doris says she would not have used the powder if she knew she was risking developing mesothelioma.
Due to how long asbestos-related complications take to develop, asbestos litigation has become the longest running mass tort in the history of the United States, with over 600,000 plaintiffs and 6,000 defendants.
Doris’ lawsuit accuses Colgate-Palmolive of being responsible for manufacturing and selling an unreasonably dangerous product. The charges in her lawsuit include negligence, false advertising, concealing information, and misrepresenting a product.
This asbestos mesothelioma lawsuit is Case No. 1:15-cv-01066-TFH, in the U.S. District Court of the District of Columbia.
