Storm8 Class Action Lawsuit Settlement

Preliminary approval has been given to a class action lawsuit settlement against Storm8, LLC, a software company that makes role-playing game apps that can be downloaded and played on the iPhone, iPod Touch and Android. If you downloaded and accessed a Storm8 game between March 2009 and August 2009, you may be entitled to 45 in-game points worth approximately $3.75 from the class action lawsuit settlement. Storm8’s games include World War, iMobsters, Kingdom’s Live, Vampires Live, Pets Live, Ninjas Live, Zombies Live, Racing Live and Rock Battle Live.

The Storm8 class action lawsuit alleges the company violated state and federal statures by using software built into its games that removed the phone numbers from approximately 3.5 million customers’ phones without authorization. Under the settlement agreement, Storm8 has agreed to distribute 45 in-game points to each class member. These points, which have a cash value of approximately $3.75, can be used toward any Storm8 game of your choice. You do not have to do anything in order to participate in the settlement. Storm8 will identify all members of the settlement class and any settlement payment that is owed to you will automatically appear. All you have to do to cash in the points is to open a Storm8 game and indicate which game you choose to receive the points on.

The settlement benefits will be distributed to class members 90 days after the settlement agreement has been given final approval and all appeals have been resolved. The final approval hearing is scheduled for November 18, 2010. Any objections to the settlement must be postmarked no later than September 13, 2010.
