Hip Pain

A DePuy hip lawsuit was filed by an Arizona resident after she suffered from severe side effects allegedly caused by the DePuy ASR metal hip implant. Plaintiff Erma B. is one of many patients who have had a metal-on-metal hip implanted and later suffered from blood poisoning, hip failure, and other dangerous side effects.

Erma claims in the hip implant lawsuit that the defendants failed to adequately test their metal-on-metal hip. She had the DePuy ASR metal hip implant surgically inserted on April 15, 2005, in her right hip and on August 8, 2006, in her left hip. Shortly after, she experienced “significant pain and weakness in her hips.” It was discovered that she had elevated cobalt and chromium levels, and that both DePuy metal hip implants had failed.

The Depuy hip lawsuit listed numerous side effects that patients, including Erma, have suffered: “metallosis, tissue death, bone erosion, the development of pseudotumors, elevated cobalt and chromium levels, component loosening, component locking, dislocation, and particulate debris resulting in severe inflammation, severe pain, tissue, and bone loss, and other related diseases.”

Erma was required to undergo painful hip revision surgery on the left hip on April 9, 2015, and states in the DePuy hip lawsuit that she will undergo hip revision surgery for the right metal hip implant, “once mentally and physically able.”

These Depuy hip implant side effects were allegedly caused by the defendant’s negligence and failure to warn. Erma experienced extremely painful hip implant side effects and was required to pay for expensive medical treatment (of which she will have to pay more when she undergoes another metal-on-metal hip revision surgery). Additionally, she has experienced emotional and physical pain and suffering, according to the hip implant lawsuit.

This Depuy hip lawsuit includes claims of design defect, manufacturing defect, failure to warn, negligence, negligent misrepresentation, breach of express warranty, and breach of implied warranty.

Metal Hip Implant Danger

The danger with metal-on-metal hip implants is that they are very difficult to implant “correctly.”  But many metal-on-metal hip implants, like the DePuy hip, include the high risk of the metal rubbing against metal, causing shavings to be released into the blood stream. This is the apparent source of the metallosis side effects noted in Erma’s metal hip implant lawsuit.

Potential awards or settlements from Depuy ASR metal hip implant claims could help plaintiffs pay for the expensive medical treatment associated with adverse metal-on-metal hip side effects, as well as for the pain and suffering caused by the defendant’s alleged negligence.

This DePuy Hip Lawsuit is Case No. 3:15-cv-02304, in the U.S. District Court of the Northern District of Texas in the Dallas Division.
