benicar-pain-womanA Benicar lawsuit filed against Daiichi Sankyo claims the hypertension drug causes severe side effects that were not warned about on the label. Several plaintiffs have complained that the drug caused them to develop sprue-like enteropathy and chronic diarrhea. Due to the number of people who filed a Benicar lawsuit, a Benicar MDL was created to consolidate these similar claims.

Plaintiff Carmen C., a Georgia resident, filed the Benicar lawsuit and joined the multidistrict ligitation after experiencing severe Benicar side effects. She claims the drug caused her to experience sprue-like enteropathy which led to her injuries and subsequent economic losses.

Carmen began taking Benicar (olmesartan) in September 2015. Following Benicar use, she began to suffer from, “chronic diarrhea, weight loss, malnutrition, vomiting, [and] nausea,” according to the Benicar lawsuit. These and other Benicar side effects have been commonly complained of in lawsuits against Daiichi Sankyo as well as Forest Laboratories, the manufacturers of the Benicar.

About Benicar

Benicar is a commonly prescribed high blood pressure medication that is used all across the nation. It has been found that patients who use the drug for four months or longer are at risk of developing sprue-like enteropathy, villous atrophy (which can be mistaken for celiac disease symptoms), and other harmful gastrointestinal side effects.

Due to the severity of the chronic diarrhea, many patients have experienced dangerous dehydration, weight loss, and malnutrition. Benicar side effects have been called “life-threatening” by the authors of a FDA report. Many people who have suffered from Benicar side effects had to be hospitalized due to the severity of the side effects.

Additionally, some Benicar users may have been misdiagnosed with celiac disease as a result of taking the drug. Benicar has been found to cause villous atrophy, which is a form of intestinal damage that mimics symptoms of celiac disease. A patient may drastically change their diet as a result of these symptoms, believing that this will “cure” their problem; however, they may not realize that their symptoms were actually caused by Benicar use.

Benicar Lawsuits

As a result of these severe side effects, many have chosen to file a Benicar lawsuit against the drug manufacturers. This Benicar lawsuit was brought before District Court Judge Robert B. Kugler and Magistrate Judge Joel Schneider. Claims include counts of design defect, failure to warn, gross negligence, negligent misrepresentation, negligent design, fraudulent concealment, violations of Georgia consumer protection laws, and punitive damages. Both Daiichi Sanjko and Forest Laboratories were named as defendants in the Benicar lawsuit.

This Benicar Lawsuit is Case No. 1:15-cv-05006 and is part of In Re: Benicar (olmesartan) Products Liability Litigation MDL No. 15-md-2606, in the U.S. District Court for the District of New Jersey.
