A Wisconsin resident has filed an asbestos cancer lawsuit against ABB Inc. and 23 other named companies, alleging that they played a role in the asbestos exposure that led to him developing mesothelioma, a cancer of the lining of the chest and the abdominal cavity.
Plaintiff Ronald C. alleges in the asbestos cancer lawsuit that while serving in the U.S. Navy and working at various jobsites in Wisconsin as a boiler tender helper, boiler tender, and equipment operator he was repeatedly exposed to asbestos-containing products and machinery requiring or calling for the use of asbestos products.
According to the asbestos cancer lawsuit, in April 2015, Ronald was diagnosed with mesothelioma as a result of his previous exposure to asbestos during his time in the U.S. Navy from 1956-1959 and as a boiler operator at Wisconsin Power and Light from 1959 to 1974. He alleges that as a result of his asbestos mesothelioma, he has experienced severe physical and mental pain and suffering, and has incurred financial loss due to substantial medical care and treatment expenses.
Ronald is filing the asbestos cancer lawsuit because he alleges that ABB Inc. and the other named defendants negligently and knowingly subjected him to exposure to dangerous asbestos and did not provide reasonable protection from asbestos exposure.
Ronald’s wife, Patricia, is also suing ABB Inc. and the named defendants, alleging loss of consortium (loss of intimacy with a spouse) as a result of her husband’s asbestos cancer and the negligence of the defendants.
What is Asbestos?
Asbestos is a naturally occurring mineral fiber that was once valued for its resistance to heat, electrical and chemical damage, and was used by dozens of trades. With millions of microscopic fibers, asbestos can easily break apart and become airborne and possibly inhaled. Should asbestos fibers be inhaled, they may become lodged in the lungs, potentially leading to lung cancer, mesothelioma or other asbestos-related diseases.
Additionally, because asbestos fibers travel so easily through the air, not only the person working with asbestos-containing products but also bystanders run the risk of inhaling these fibers and developing an asbestos-related disease even decades after exposure.
From the early 1900s through the 1980s, asbestos was used in thousands of different industrial products, including pipe and furnace insulation materials, roofing shingles, floor tiles, millboard, textured paints and other coating materials.
In 1989, the United States banned asbestos in specific products. This ban, however, did not ban the use of asbestos altogether. Additionally, other countries continue to mine asbestos. As a result, asbestos can still be found in a number of consumer products, including building materials, friction products and heat-resistant fabrics.
Asbestos Exposure
Companies and manufacturers dealing with asbestos have known for almost a century that the inhalation of asbestos fibers is associated with mesothelioma, lung cancer, asbestosis and several other debilitating and often fatal asbestos-related diseases. Thousands of unsuspecting workers were exposed daily to this dangerous carcinogen as they worked in factories, mills, railroads and other industrial occupations, often bringing asbestos fibers home and unknowingly exposing their family members to the fibers.
