HSBC class actionConsumers who allegedly received an unwanted phone call from HSBC Bank or a third-party company calling on behalf of HSBC between 2008 and 2012 are receiving checks in the mail from a settled TCPA class action lawsuit.

The HSBC TCPA class action settlement checks stem from the class action lawsuit known as Wilkins, et al. v. HSBC Bank Nevada, N.A., which alleged HSBC employed an automatic telephone dialing system to place pre-recorded messages or robocalls to consumers’ cell phone between May 31, 2008, and May 1, 2012, in violation of the Telephone Consumer Protection Act.

HSBC Bank has denied all liability in this TCPA class action lawsuit. However, the defendant has agreed to this HSBC TCPA class action settlement to settle the various TCPA violation claims brought against the institution and to avoid further court expenses and the uncertainty of future trials. As part of this HSBC class action settlement, HSBC has agreed to establish a $39,975,000 TCPA settlement fund, which is being used to award qualifying Class Members of this TCPA class action lawsuit who submitted a complete and timely HSBC TCPA Claim Form.

Class Members of this HSBC TCPA class action settlement include all individuals within the United States who received a non-emergency call to their cell phone from HSBC Card Services Inc., or any third-party group on behalf of HSBC Finance Corp. or HSBC Bank Nevada, on or after May 31, 2008 through May 1, 2012, which used an automatic telephone dialing system or a prerecorded voice.

The deadline to file a claim for the class action settlement passed on Nov. 4, 2014.
