toysrus-facta-lawsuitToys R Us, which is among the many companies facing Fair and Accurate Credit Transaction Act (FACTA) class action lawsuits, has reached a settlement.

FACTA states that companies must follow certain rules regarding how companies treat customers’ credit and debt cards, including receipts. Toys R USshas been accused of including more than five digits of customers’ credit and debit cards on their credit card receipts (as well as debit card receipts.) These are FACTA violations which have forced companies to give compensation to the customers.

What is FACTA?

FACTA took effect in 2003 as a way to protect against identity theft. The two primary ways that FACTA rules protect against this is that it prohibits a company from including more than five digits of a customer’s card information on the debit card receipt/credit card receipt and forbids any part of credit and debit cards’ expiration date.

It is important to note that only the last five digits may be on the receipt. No other numbers, even if they amount to less than five, may be shown on a receipt.

Typically, credit card receipts will include symbols in place of card numbers.

Toys R Us FACTA Class Action Lawsuit Settlement

A FACTA class action lawsuit settlement with Toys R Us was recently approved by a federal judge. Customers who used credit and debit cards to make a purchase at the chain between Dec. 4, 2006 and Jan. 5, 2007 may be eligible to win vouchers from the company.

Toys R Us maintained that it was not guilty of any FACTA violations but sought to resolve the litigation and agreed to the FACTA class action lawsuit settlement.

There are three tiers of vouchers that may be claimed depending on the number of purchases made at the store. Tier A gives a plaintiff two $15 vouchers if the plaintiff can show proof of at least three purchases made during the previously stated window. This evidence can be the original credit card receipts/debit card receipts as well as bank statements.

Tier B gives a plaintiff one $15 voucher for less than three items purchased. Tier C grant one $5 voucher if a plaintiff has no documentation but swears under the penalty of perjury that they fit into the FACTA class action lawsuit and are entitled to a settlement.

Toys R Us is one of potentially many companies that could be held responsible for alleged FACTA violations.
