Plaintiff Amelia H. filed a Benicar lawsuit accusing Daiichi Sankyo of causing and failing to warn about the severe sprue-like enteropathy that could follow Benicar use. Benicar diarrhea has allegedly caused the plaintiff great pain and suffering.

Benicar was approved as a blood pressure medication. Many individuals have used the drug without being aware of the severe Benicar side effects that could follow. In 2013, the FDA issued a warning about Benicar (and other olmesartan drugs) stating that the drug “can cause intestinal problems known as sprue-like enteropathy.” The label was changed accordingly at this point.

Before that label update, many had already developed Benicar diarrhea. However, those suffering may not have been aware that their blood pressure medication was causing their illness, especially considering that sprue-like enteropathy can develop months or even years after Benicar use has begun.

Benicar Lawsuit

Amelia is one such individual who developed Benicar sprue-like enteropathy. This does not entail just diarrhea. The Benicar lawsuit stated that this condition “resulted in Plaintiff suffering from chronic diarrhea, rapid weight loss, nausea, vomiting, malnutrition, dehydration, and/or acute renal failure.”

The Benicar lawsuit also alleged that Daiichi Sankyo, the manufacturer, “engaged in a campaign of over-promoting the olmesartan products in written marketing literature, in written product packaging, and in direct-to-consumer advertising via written advertisements and television commercial ads” while downplaying the potential Benicar side effects. This allegedly led to many, including Amelia, taking the drug without being aware that they could develop a harmful condition.

“After developing these injuries, Plaintiff was hospitalized on multiple occasions suffering from chronic diarrhea, acute renal failure, severe anemia, weakness, nausea, and/or weight loss,” the Benicar lawsuit states.

Amelia has been continually monitored due to these alleged Benicar side effects. Throughout this process, she has accrued large medical bills due to the treatments and hospitalizations that were required to manage her injuries. The Benicar lawsuit seeks to win compensation for Amelia for the grievances allegedly caused by Daiichi.

Counts in this Benicar lawsuit include defective design, failure to warn, strict liability, gross negligence, negligence and failure to warn, negligent misrepresentation, fraudulent concealment, constructive fraud, fraud, civil conspiracy, and breach of warranties.

Benicar diarrhea has caused many individuals to file Benicar lawsuits against Daiichi who allegedly knew or should have known about sprue-like enteropathy side effects and failed to warn against them. Some lawsuits may be filed after the Benicar side effects have passed depending on when they discovered that Benicar was the source of their sprue-like enteropathy.

This Benicar Lawsuit is Case No. 1:15-cv-02978, in the U.S. District Court for the District of New Jersey (Camden).
