lipitor-diabetes-testA Lipitor type-2 diabetes lawsuit alleges the cholesterol medication caused a woman to develop type-2 diabetes, a condition that will be with her for the rest of her life. The Lipitor lawsuit, originally filed in Maryland, is now consolidated into the Lipitor MDL in South Carolina federal court.

Plaintiff Mavis N. filed the Lipitor type-2 diabetes lawsuit against Pfizer Inc., the manufacturer of popular cholesterol medication, Lipitor. Mavis used Lipitor from May 2000 until Jan. 2002. She resumed Lipitor use in Aug. 2006 and continued until Sept. 2008. The now 84-year-old Maryland resident was diagnosed with Lipitor type-2 diabetes in 2004.

The Lipitor type-2 diabetes lawsuit claims that Mavis “has suffered severe and permanent physical and emotional injuries including but not limited to, the development of Type 2 Diabetes as a result of her ingestion of the prescription drug Lipitor (atorvastatin calcium).”

Claims in this Lipitor type-2 diabetes lawsuit included negligence, negligent misrepresentation, negligent design, design defect, failure to warn, breach of express and implied warranty, fraud and misrepresentation, constructive fraud, and unjust enrichment.

Lipitor Type-2 Diabetes

Type-2 diabetes is a condition that, once developed, becomes a permanent aspect of the patient’s life. Although medications may be used to treat type-2 diabetes side effects and symptoms, the patient will be required to continue medication, diet changes, and lifestyle changes for the rest of their life. While there are many factors that can lead to a type-2 diabetes diagnosis, drugs like Lipitor can also increase this risk.

Those involved in the Lipitor MDL allege that the drug directly caused their condition. However, Pfizer lawyers claim that the plaintiffs were predisposed to develop type-2 diabetes from their high cholesterol, which Lipitor is used to treat.

Many women allege that the popular cholesterol medication caused them to develop type-2 diabetes. As a result, many Lipitor lawsuits have been filed. Many have been consolidated into a Lipitor MDL or multidistrict litigation. MDLs may be used to group together many individual lawsuits with similar claims filed against the same defendant(s).
