Stryker hip implant lawsuitGeorgia resident Robert M. has filed a metal-on-metal hip implant lawsuit after experiencing adverse side effects allegedly caused by Stryker Orthopaedics hip replacement. This metal hip implant lawsuit was consolidated into the pending Stryker hip multidistrict litigation filed in Minnesota.

The plaintiff had a Stryker Modular metal-on-metal hip implanted into his right hip in October 2009. However, just five years later, he reportedly had to have the metal hip implant removed due to serious adverse side effects involving high levels of chromium and cobalt in his blood.

Robert claims he did not know that his injures were caused by the hip implant device “until after the date the Device was recalled from the market.”

The metal-on-metal hip implant lawsuit also states, “Plaintiff could not have known that he was injured by excessive levels of chromium and cobalt until after the date he had his blood drawn and he was advised of the results of said blood-work and the fact that those blood work abnormalities were attributable to a defect in the Device at issue.”

Because Stryker did not warn against these hip replacement side effects, many users, including Robert, may have been unaware of the source of their side effects and in some cases may not have been aware that they needed to get their blood checked for cobalt poisoning.

This metal-on-metal hip implant lawsuit includes counts of negligence, negligence per se, defective design, manufacturing defect, failure to warn, breach of express and implied warranties, breach of warranty as to merchantability, negligent misrepresentation, and unjust enrichment.

Robert is seeking damages for the pain and suffering caused by the metal hip implant as well as costs for legal fees and medical fees.

Metal-on-Metal Hip Implant Complications

  • Metallosis or metal poisoning due to chromium or cobalt particles from the hip implant leaking into nearby tissue or the patient’s bloodstream

Metal-on-metal hip implant lawsuits may be filed after experiencing these side effects. Wrongful death lawsuits may be filed if the hip replacement complications caused fatal side effects.
