A fibrous material asbestos played such a role in the industry of a Wisconsin town that a man who never worked in any facilities where it was used still succumbed to a fatal form of asbestos-related cancer, a recently filed mesothelioma lawsuit states.
Valmore Prust was reportedly exposed to asbestos as a result of a Weyerhaeuser Company door factory in his hometown from 1960 to 2000. The company produced products using a process licensed from named defendants Owens-Illinois and Roddis. According to his wife’s mesothelioma lawsuit, he was also exposed to asbestos-containing products sold by General Electric.
However, his wife worked at those facilities, and the mesothelioma lawsuit alleges that she “brought home asbestos fibers on her person” as a result of more than 40 years of employment at those facilities. Even if she had not, though, it is alleged that the Weyerhaeuser “polluted the town of Marshfield with asbestos-containing materials, asbestos dust, and asbestos fibers emanating from asbestos-containing materials used at the plant.”
Valmore Prust was diagnosed with mesothelioma on Jan. 5, 2010 and died roughly three years later on May 17, 2013. As a result, his wife, Virginia, is suing the defendants on counts of negligence, unreasonably dangerous products, negligence, nuisance and conspiracy. The latter charge is related to the alleged violation of government regulations for disposal of the material to limit asbestos exposure for residents. Weyerhaeuser reportedly dumped asbestos in a nearby airport and at various other locations.
The mesothelioma lawsuit is Virginia Prust, et al. v. Weyerhaeuser Company, et al., Case No. 13-cv-00654, in the U.S. District Court for the Western District of Wisconsin.
