Bald man headA new Propecia lawsuit was recently filed in a New York federal court against the pharmaceutical manufacturer Merck & Co. Inc.

Plaintiff Brandon R., a resident of the state of Washington, filed the Propecia lawsuit against Merck. Brandon received a prescription and began using Propecia in November of 2010, he explains in Propecia lawsuit.

While taking the medication, Brandon allegedly began to suffer from erectile dysfunction and other related sexual dysfunctions. According to the Propecia lawsuit, Brandon continues to suffer from these symptoms. He is seeking both compensatory and punitive damages.

Overview of Propecia Lawsuits

Propecia, generically known as finasteride, is a prescription medication used to treat male pattern baldness and enlarged prostate (or benign prostatic hyperplasia).

Since Propecia was first approved by the FDA in 1992, over 1 million people in the United States have used the medication. Although the Propecia drug label warned consumers that some users may experience sexual dysfunction side effects such as erectile dysfunction, decreased libido, depression, and ejaculation disorder, the company failed to report until recently that these sexual dysfunction side effects often continue even after patients stopped taking the medication.

Instead the drug maker marketed the drug as a safe treatment with minimal risks. Propecia lawsuits allege that Merck knew of these persistent and permanent side effects almost four years prior to updating their drug labeling.

Currently Merck is facing over 1,200 Propecia lawsuits, all filed by men who took finasteride and allegedy suffered persistent or permanent side effects. Propecia lawsuits allege that Merck violated consumer protection laws by failing to warn the medical community and the general public about the persistent and ongoing risks associated with using Propecia.

Claims against the pharmaceutical company include fraudulent concealment, strict product liability, negligence, breach of warranty, fraud, violations of unfair and deceptive trade practices act, and infliction of emotional distress.
