Adobe Data Breach LawsuitAdobe Systems Inc. has reportedly reached an agreement to settle a consolidated class action lawsuit over allegations it failed to protect users’ data, which was compromised in a 2013 data breach. The Adobe data breach allegedly resulted in the release of information for at least 3 million payment card records and compromised the personal data of millions of Adobe users.

According to court documents filed Wednesday, the parties to the Adobe data breach class action lawsuit have signed a memorandum of understanding and expect to file a motion for preliminary approval of the proposed data breach settlement by the end of May. The parties had initially informed the presiding judge that the deal would be reached by the April 30, but found that finalizing the settlement terms was “more difficult and time consuming than they initially anticipated.”

U.S. District Judge Lucy H. Koh granted the parties’ request to extend the deadline and rescheduled the case management conference for June 10, 2015.

On Oct. 3, 2013, Adobe announced that hackers stole login data for an undetermined number of users as well as approximately 3 million credit and debit card records. Following the announcement, Adobe was hit with a class action lawsuit by Adobe customers and Creative Cloud subscribers who accused Adobe of failing to implement adequate security measures to safeguard their personal information. The Adobe data breach class action lawsuit also alleged Adobe failed to inform customers about the full extent of the breach until several weeks after the announcement. The Adobe data breach reportedly affected close to 38 million Adobe users.

Adobe has vigorously fought the data breach litigation, but has been unsuccessful. In Septemeber 2014, Judge Koh denied Adobe’s attempt to dismiss the class action lawsuit, finding that it was plausible that the plaintiffs were “immediately in danger of sustaining some direct injury as the result of the challenged conduct.”
