Biomet-logoOn March 19, a metal hip implant lawsuit was filed against Biomet Orthopedics Inc., by a New York man who alleges he sustained personal damages after undergoing hip replacement in which Biomet’s Magnum Total Hip Arthroplasty System was used.

Plaintiff Robert G. claims in his metal on metal hip implant lawsuit that he was implanted with the Magnum metal hip implant back in 2007, a device that he claims is defectively designed, necessitating an early removal and hip revision surgery for Robert in 2014.

According to the Biomet metal hip implant, “after the surgery, friction and wear between the metal head and metal linear caused cobalt and chromium metal ions and particles to be released into plaintiff’s blood.

“In September of 2014, blood tests showed elevated levels of chromium and cobalt in the plaintiff. As a result of the elevated levels of chromium and cobalt, the plaintiff’s surgeon advised him that the Magnum Device had to be removed.”

Robert further alleges in the metal hip implant lawsuit that Biomet was aware that the Magnum metal-on-metal hip implant created metal debris that can damage bodily tissue and cause other metal hip implant side effects.

Additionally, Biomet allegedly, “promoted the Magnum Device as superior to and safer than other hip replacement systems,” especially because it was a metal hip replacement rather than a conventional hip implant with a polyethylene liner, when in fact the Magnum hip implant posed more dangerous complications than a traditional hip implant.

This Magnum metal hip implant lawsuit brings several allegations against Biomet, the manufacturer of this allegedly dangerous metal and metal hip replacement product, including: negligence, strict products liability, breach of warranty, and breach of implied warranties.

Robert is seeking monetary compensation from the defendant for the pain and suffering he suffered due to their metal hip replacement product, as well as for the medical expenses related to the initial hip implant surgery, the subsequent revision surgeries, and other metal hip implant side effects that necessitated medical attention.

The Biomet Metal Hip Implant Lawsuit is Case No. 3:15-cv-00142-RLM-CAN, in the U.S. District Court for the Northern District of Indiana.

Background on Biomet’s Magnum Hip Replacement System

Robert is not the only patient alleging that his Biomet Magnum hip replacement system failed and caused severe and often painful complications.
