eMachines Extends Cash Option Deadline for Class Action Settlement
By Dominic Rivera
Consumers who participated in the eMachines floppy disk class action settlement (Stroud v. eMachines Inc.) now have more time to redeem their certificates for cash, according to an update on the Settlement Administrator site. If you have not previously used your certificate for a product redemption, this update is for you:
“Although the deadline for submitting a request for cash redemption is listed on your certificate as 45 days from receipt of the form, the deadline has now been extended and requests for cash redemption will be considered up to Dec. 1, 2013.”
This extension is for the option to redeem a certificate for cash and not for submitting a Claim Form, which has already passed. [See our claim filing instructions here.] Each Returned Goods Credit Certificate is good for $62.50 cash.
The certificates are part of a class action lawsuit settlement over allegations that eMachines sold computers with a defective part that could cause the loss or corruption of data written to, or read from, a floppy disk. The defendants deny all of the claims made in the lawsuit. The Court did not rule in favor of plaintiffs or defendants. Instead, the parties agreed to the Proposed Nationwide Settlement in order to avoid the expense and risks of continuing the action and the related cases. The eMachines settlement was approved after its final hearing on March 25, 2013.
Take note that if you were issued more than one certificate, you can exchange multiple certificates for cash by entering each certificate number and PIN number one at a time on the Settlement Administrator’s site. You must provide the certificate number for each approved claim. You may only redeem a certificate number one time and any certificate number redeemed for goods will not be eligible for cash election.
The eMachines Floppy Disk Class Action Lawsuit Settlement is Stroud v. eMachines Inc., Case No. CJ-2003-968-L, U.S. District Court, Cleveland County, State of Oklahoma.
