In early April, a Las Vegas widow filed an Axiron lawsuit against Eli Lilly and Co. as part of the larger, nationwide testosterone product multidistrict litigation (MDL) movement. This Axiron testosterone products lawsuit claims the plaintiff’s husband died from testosterone gel side effects, including cardiac arrest.

Plaintiff Gail M. filed this Axiron lawsuit on behalf of her now deceased husband Vincent D., who began testosterone replacement therapy in December 2011 by taking Eli Lilly’s brand name testosterone product, Axiron. Gail alleges that due to a heart attack that he suffered because of his use of Axiron, he died sometime in January of 2013.

This Axiron testosterone product lawsuit brings several claims against Eli Lilly, including design defect, failure to warn, negligence, negligent misrepresentation, breach of implied warranty of merchantability, breach of express warranty, fraud, redhibition, consumer protection, unjust enrichment, wrongful death, survival action, loss of consortium, and punitive damages.

Gail is seeking relief and damages from Eli Lilly and has also requested a jury trial for this Axiron lawsuit.

The Testosterone Product MDL is In Re: Testosterone Replacement Therapy Products Liability Litigation, MDL No. 2545, in the U.S. District Court for the Northern District of Illinois.
