New oak parquetAn Indiana couple has filed a Lumber Liquidators lawsuit, alleging that their toxic wood flooring products endangered their health.

Plaintiffs Steven and Sarah J. claim in their Lumber Liquidators class action lawsuit that the wood floors they purchased from Lumber Liquidators and installed in their home had dangerously high formaldehyde levels.

Formaldehyde is a bonding agent that binds the wood fibers together and is often used to laminate or coat wood flooring. Unfortunately there are a number of heath risks linked to this chemical, including lung cancer, resulting in very strict regulations from different wood flooring and textiles providers, such as the defendant.

The plaintiffs purchased the wood from the defendant on Jan. 17, 2014 for $2,340.43, and made another purchase on Jan. 28, 2015, for $2,537.65, fully aware that the wood was manufactured in China, they explain in their Lumber Liquidators toxic flooring class action lawsuit.

However, Steven and Sarah were unaware that the wood’s formaldehyde levels far exceeded what is permitted in federal and California state regulations. The couple also have young children, and one of these children suffers from asthma.

At the time the plaintiffs purchased the wood, they had been under the assumption that it had been up to the California Air Resources Board (CARB) standards, which is considered one of the strictest in the United States. They had purchased this wood for the specific reason that it was advertised to meet the CARB standards as well as the federal standards, which would have ideally made it one of the safest options to install.

Now the couple and their children must remain vigilant in watching out for any signs of side effects from the wood including any abnormal coughing or wheezing, they allege in their Lumber Liquidators class action lawsuit. They also must consider different options in replacing the floor boards, which will prove to be financially damaging for the couple. Steven and Sarah say in the Lumber Liquidators toxic flooring lawsuit that they never would have bought the wood flooring if they had known about the high levels of formaldehyde.

The Lumber Liquidators class action lawsuit claims that the company fraudulently sold them the defective flooring, while being fully aware that the wood could be hazardous to their clients’ health.

Additionally, the attorneys state that the defendant had the responsibility to warn their clients and other Lumber Liquidators consumers of the risks of their defective products, because the consumers rely on the accuracy of the wood flooring product labels.

Steven and Sarah are suing Lumber Liquidators for negligence, false advertising, concealing information, and misrepresenting a product.

This Lumber Liquidators Class Action Lawsuit is Case No. 1:15-cv-00395-RLY-MJD, in the U.S. District Court for the Southern District of Indiana, Indianapolis Division.

Overview of Lumber Liquidators Allegations

This litigation movement started when the CBS News television program, “60 Minutes,” aired an episode focusing on Lumber Liquidators in March. The episode investigated whether or not the company had sold wood flooring with high levels of formaldehyde.

Across the country, customers have been devastated to learn of this event and have had to have the wood floors removed and replaced. Many of them may qualify to file a Lumber Liquidators lawsuit or join a toxic flooring class action lawsuit to pursue compensation.
