Goodyear Tire & Rubber Co. has reached a settlement agreement in a wrongful death lawsuit that alleged a former U.S. Navy worker died from malignant mesothelioma as a result of being exposed to asbestos. Terms of the settlement are confidential, but the agreement is slated to be finalized within the next 60 days.
Patti D., the wife of deceased Patrick D., filed an asbestos lawsuit in July 2011 accusing defendant Goodyear Tire & Rubber Company and others of gross negligence. Patrick was a Navy aircraft repairman and while working allegedly was exposed to asbestos-containing products from Goodyear. His asbestos exposure resulted in him being diagnosed with malignant mesothelioma from which he passed.
The family of Patrick claims that Goodyear Tire was aware for many decades that asbestos exposure could cause diseases like lung cancer. However, the company still allowed employees and contractors to work with and near the toxic material. The asbestos lawsuit further alleges that Goodyear negligently and knowingly subjected Patrick to dangerous asbestos exposure and did not provide reasonable protection.
Occupational Asbestos Exposure
Though it has been established that exposure to asbestos can cause lung cancer, and the greater the exposure to asbestos, the greater the risk that lung cancer will crop up, lung cancer isn’t the only health problem linked to asbestos exposure. Exposure to asbestos fibers has been linked to lymphoma, asbestosis (scarring of the lungs that restricts breathing), asbestos mesothelioma (cancer of the lining of the chest cavity), and silicosis. The chances of getting an asbestos-related illness increase as the level and duration of exposure to asbestos increases.
