Vaginal Mesh Complications

Vaginal mesh can begin to erode through the vaginal walls or other organs within weeks or months after the initial vaginal mesh insertion surgery. These transvaginal mesh problems can hinder any number of activities women perform on the daily basis, including sitting, walking, and sexual intercourse. The physical and emotional harm can affect women’s work, relationships, and daily activities. Some experts argue that the transvaginal mesh is not safe and was not properly tested before being implanted into women.

With all of the complications associated with vaginal mesh, doctors from the American College of Obstetricians and Gynecologists recently issued an article titled, “What Is New in the Use of Mesh in Vaginal Surgery?” providing information published in the past year on vaginal mesh complications.

One significant detail about transvaginal mesh or bladder slings (medical devices used to treat pelvic organ prolapse and stress urinary incontinence) is that removing the mesh implant doesn’t always repair the side effects caused by having the vaginal mesh implanted in the first place. The article, written by Dr. John R. Fischer of the Department of Obstetrics and Gynecology at the Uniformed Services University of the Health Sciences in Bethesda, MD, states:

“Complications from placement of permanent synthetic mesh for vaginal prolapse repair are well-documented, but there is little to guide physicians regarding outcomes after surgical removal of trans-vaginal mesh. This is a retrospective review of patients who underwent excision of trans-vaginal mesh owing to complications. The most common issues were pelvic and vaginal pain, mesh exposure, and a bulge sensation. … After removal, 51% of patients reported complete resolution of their symptoms, with mesh exposure mostly likely to respond to treatment. Of those who presented with pain, 51% reported persistent pain after excision.”

Dr. Fischer concludes that persistent pain is the most difficult vaginal mesh symptom to deal with and is not easily resolved with simply removing the vaginal mesh or bladder sling product. Additionally, patients with a history of chronic pain may not be ideal candidates to for synthetic mesh products like trans-vaginal mesh devices.

Overview of Vaginal Mesh Litigation

Women who file transvaginal mesh lawsuits allege that vaginal mesh manufacturers have a legal duty to ensure the safety and effectiveness of their pelvic mesh products, but instead provide patients with false and misleading information about the products’ effectiveness and safety. Many juries have agreed with the plaintiffs’ claims.

In July 2012, a California jury awarded a women and her husband $5.7 million after she underwent nine revision surgeries as a result of complications from her C.R. Bard Avaulta Plus mesh product.

Additionally, in February 2013, a New Jersey woman won $3.5 million in her vagina mesh lawsuit against Johnson & Johnson’s Ethicon brand over its Prolift vaginal mesh product and the 18 surgeries she allegedly underwent to correct side effects from her vaginal mesh implant.

Finally, a West Virginia jury awarded a woman $3.27 million in August 2013 against C.R. Bard after she was implanted with the company’s Avaulta Plus mesh and suffered serious vaginal mesh complications.

The outcomes of the above referenced vaginal mesh lawsuits may spell favorable court outcomes for other women who are considering filing a vaginal mesh lawsuit or joining a vaginal mesh class action lawsuit.
