Another vaginal mesh lawsuit joined the collection of vaginal mesh lawsuits against Ethicon, a subsidiary of medical giant Johnson & Johnson.
Plaintiff Brenda F. alleged she received a vaginal mesh implant in New York in July 2004, and went on to suffer from serious vaginal mesh complications. Her individual vaginal mesh lawsuit is somewhat sparse on details, since it is intended to be filed in a larger coordinated group of vaginal mesh lawsuits through a process called a multidistrict litigation, or MDL.
MDLs allow the court system to coordinate similar cases to help streamline the legal system for all parties involved. Vaginal mesh lawsuits are ideal for inclusion in a MDL since they typically make similar allegations and hinge on similar evidence.
However, since vaginal mesh complications have been reported across a wide variety of brands and models of vaginal mesh, there are at least half a dozen different vaginal mesh MDLs to coordinate vaginal mesh lawsuits against different vaginal mesh manufacturers. In this case, this vaginal mesh lawsuit will join the MDL that is organizing the vaginal mesh lawsuits against Ethicon, one maker of vaginal mesh.
Vaginal mesh is a type of surgical mesh, designed to help support and protect pelvic organs when injury, disease, or damage weakens their normal support structures. Vaginal mesh was based on an existing medical technology, surgical mesh that has been widely used in human surgery since the 1970s.
Because surgical mesh is a tried and tested product, medical companies like Ethicon were able to skip several phases of FDA testing, thanks to the sometimes-controversial 501(k) program, which allows medical implants that are “substantially similar” to existing technologies to skip most phases of FDA testing. However, vaginal mesh lawsuits allege that vaginal mesh may carry risks of its own.
Allegedly, vaginal mesh can cause a host of serious medical problems. Vaginal mesh lawsuits have alleged that vaginal mesh may cut through the very tissue it is designed to protect and support through the action of mechanical friction, a condition called mesh erosion.
Additionally, it has been alleged that mesh may stimulate tissue to grow around it, leading to mesh embedment. Vaginal mesh lawsuits have also alleged that vaginal mesh relies on dangerous attachment points in the nerve-rich tissue at the bottom of the spinal column.
Vaginal mesh lawsuits typically allege that the makers of vaginal mesh did not do enough to protect the general public against the risk of pelvic mesh complications, and may not have even adequately tested vaginal mesh, leading to an allegedly-defective product.
Vaginal mesh lawsuits typically seek to recoup medical costs allegedly linked to vaginal mesh, including the cost of surgical removal and correction, as well as lost wages and lost income potential, and other costs allegedly stemming from vaginal mesh complications.
