An Actos bladder cancer lawsuit was filed in New York against Takeda Pharmaceuticals. Plaintiff Roman B. filed the complaint, along with his spouse, after developing dangerous bladder cancer after using Actos to treat his type-2 diabetes.
Actos was approved in 1992 to treat type-2 diabetes and has since been used by thousands of individuals across the nation. Type-2 diabetes can never be fully cured, only managed through proper diet and medication. Therefore, the Actos bladder cancer side effects that can allegedly follow Actos use are alarming given the amount of time the average patient might take Actos.
Actos Warnings
In 2007, Takeda Pharmaceuticals was forced to add a warning about heart failure side effects. The Actos bladder cancer lawsuit states, “Despite the [newly added] warning, Defendants have promoted and continued to promote Actos as cardioprotective.” It was suggested that the case is similar with Actos bladder cancer, that Takeda was aware of potential Actos side effects, failed to advertise them, and continued to market their drug as safe and effective across the country.
In 2011, the U.S. Food and Drug Administration (FDA) found that patients who use Actos for more than a year have an “increased risk of bladder cancer,” states the Actos bladder cancer lawsuit.
Actos Bladder Cancer Allegations
Roman began to use Actos to treat type-2 diabetes beginning in 2007, according to the Actos lawsuit. In 2011, he was diagnosed with bladder cancer. This bladder cancer reportedly caused him extreme pain and suffering and caused him to undergo surgery.
According to the Actos bladder cancer lawsuit, “The product warnings for Actos in effect during the time period [Roman] used Actos were vague, incomplete or otherwise inadequate, both substantively and graphically, to alert prescribing physicians as well as [Roman] of the bladder cancer risk.”
Roman claims that had he been aware of Actos side effects, he never would have used Actos and would have treated his type-2 diabetes in another manner.
Actos bladder cancer, though treatable in this case, will put Roman at risk of developing cancer in the future and will require monitoring for his entire life.
Claims in this Actos lawsuit include negligence, failure to warn, defective design, breach of express warranty, breach of implied warranty, violations of New York business laws, as well as fraud and fraudulent concealment. Roman’s wife Svetlana joined her husband in the complaint and filed for loss of consortium, or loss of intimacy with a spouse. Both plaintiffs hope to win compensation for medical costs, legal fees, the pain and suffering that came from the alleged Actos bladder cancer.
