A Benicar lawsuit recently filed in the state of Arizona accuses drug makers Daiichi Sankyo and Forest Laboratories of negligence, failure to warn, and other Benicar injury claims. This is one of many Benicar lawsuits that has been filed after the blood pressure drug allegedly led to severe cases of sprue-like enteropathy.

Sprue-like enteropathy is a miserable condition that leads to “severe chronic diarrhea with nausea and abdominal pain,” according to the Benicar lawsuit. It also commonly leads to weight loss and dehydration as well. Individuals, such as plaintiff Michelle P., are often hospitalized due to the severity of Benicar side effects.

Michelle began to use Benicar to treat her high blood pressure in 2010. During her treatment, she experienced sprue-like enteropathy and chronic diarrhea which led to permanent injuries, according to the Benicar lawsuit. She was not aware at the time that her condition was caused by Benicar.

Benicar Side Effects

The Benicar lawsuit claims that the drug manufacturers were or should have been aware of Benicar side effects and that they failed “to adequately conduct complete and proper testing of Benicar.” Because of this, Michelle and countless other victims were allegedly put at risk of developing unknown Benicar side effects like sprue-like enteropathy and chronic diarrhea.

Other individuals claim that the drug caused them to be falsely diagnosed with celiac disease. Because Benicar side effects mimic symptoms of celiac disease, many patients are often misdiagnosed when in fact they are experiencing a severe side effect of Benicar known as villous atrophy, which can cause similar symptoms as celiac disease. While patients could have been treating the actual source of their health issue, they were changing their diet and lifestyle to adapt to the condition they believed they had. Some Benicar lawsuits have been filed due to this alleged side effect.

Benicar Lawsuits

Benicar lawsuits have been filed in order to help cover the expenses of treating and managing sprue-like enteropathy as well as to compensate for the pain and suffering that this and other side effects of Benicar can bring.

Claims in this Benicar lawsuit include fraudulent concealment and tolling, design defect, manufacturing design, failure to warn, breach of implied warranty, breach of express warranty, negligence, negligence per se, fraud, negligent misrepresentation, and conscious indifference.

The Benicar lawsuit states, “At all time material hereto, Defendants knew or should have known that [Benicar] was inherently dangerous when used for the treatment of high blood pressure in that it caused serious side effects including, but not limited to sprue-like enteropathy.”

Had the manufacturers adequately warned individuals such as Michelle about dangerous Benicar side effects, Michelle and countless individuals may have been able to choose alternative blood pressure treatment and could have avoided miserable side effects.

The Benicar Lawsuit is Case No. 2:15-cv-00227, in the U.S. District Court for the District of Arizona.
