Class Members who submitted timely and valid claims for the Sinus Buster, Vioxx and/or Nutella class action settlements may soon be getting a check in the mail, if they haven’t received them already.

Sinus Buster Class Action Settlement

Viewers are reporting they have received checks worth $10 from the Sinus Buster class action settlement.

The Sinus Buster class action settlement resolves allegations that Hi-Tech Pharamcal Co. misrepresented the efficacy of its Sinus Buster products. Hi-Tech denies the allegations but agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

Under the terms of the class action settlement, consumers who purchased Sinus Buster products between March 7, 2012 and Feb. 20, 2014 were eligible to file claims for a refund. Class Members who submitted proof of purchase were eligible to receive a full refund for the actual purchase price of the product(s) they purchased, while Class Members without proof of purchase could receive a refund of $5 per affected product they purchased.

The Sinus Buster Class Action Lawsuit is In re: Sinus Buster Products Consumer Litigation, Case No. 1:12-cv-2429-ADS-AKT, in the U.S. District Court for the Eastern District of New York.

Vioxx Class Action Settlement

Viewers are reporting they have received checks worth $50 from the Vioxx class action settlement.

The Vioxx settlement resolves multiple class action lawsuits (consolidated as In re: Vioxx Products Liability Litigation) that allege Merck Sharp & Dohme Corp. misled consumers by claiming Vioxx had greater benefits than cheaper generic NSAIDs even though no such benefits had been established.

Merck denies the allegations but agreed to settle the class action lawsuit to resolve the litigation. Class Members of the Vioxx class action settlement include all consumers who purchased Vioxx for personal or family use before Oct. 1, 2004. Under the terms of the Vioxx settlement, Class Members who submitted timely and valid Claim Forms were eligible to receive a cash award of up to $50 or $75.

The Vioxx Class Action Lawsuit is In re: Vioxx Products Liability Litigation, MDL No. 1657, in the U.S. District Court for the Eastern District of Louisiana.

Nutella Class Action Settlement

Consumers who submitted claims for the nationwide Nutella class action settlement are reporting they are receiving checks in the mail!

The Nutella class action settlement resolves several class action lawsuits (consolidated as In re: Nutella Marketing and Sales Practices Litigation) that alleged Ferrero USA Inc. deceptively marketed, advertised and sold its Nutella chocolate-hazelnut spread as a nutritious food without indicating the nutritional value was based on other foods served with the spread, such as milk, fruit and bread.

Ferrero denies any wrongdoing but agreed to settle the class action lawsuit to avoid ongoing litigation. Class Members of the nationwide Nutella class action settlement include consumers who purchased Nutella in any state other than California between Jan. 1, 2008 and Feb. 3, 2012. Class Members could submit claims to receive up to $4 per jar of Nutella purchased during the Class Period, up to a maximum of $20 per household.

California consumers reported receiving checks from the state Nutella class action settlement in December.

The Nutella Class Action Lawsuits are In re: Ferrero Litigation, Case No. 3:11-cv-00205, in the U.S. District Court for the Southern District of California, and In re: Nutella Marketing and Sales Practices Litigation, Case No. 3:11-cv-01086, in the U.S. District Court for the District of New Jersey.

    yes, many of these settlements i have not received any checks and applied to most! beginning to think–mailperson–or worker at claims offices!

    I received the sinus buster and Nutella check yesterday….nothing from vioxx. I did receive a letter asking for info I guess for taxes, which I sent in. Not check from vioxx.

    Receive $10 sinus Buster and $7.15 Nutella today, Nothing from Vioxx, I send them a copy of my pharmacy receipts. I took Vioxx until the recall. Hopefully I will get a check. Good Luck to all.
