Hip replacement implantJohnson & Johnson agreed to pay an additional $420 million in DePuy ASR metal hip implant lawsuit settlements to over 1,000 plaintiffs who filed lawsuits before the extended deadline.

The litigation for these DePuy ASR metal hip lawsuits began almost five years ago when thousands of DePuy hip replacements failed across the nation. Patients were forced to undergo hip revision surgery to remove the hip implant devices, a process that was painful as well as expensive.

Plaintiffs were given an original deadline to decide if they were going to accept the DePuy hip implant settlement offer or if they were going to continue their lawsuit. Plaintiffs who underwent hip revision surgery after suffering from DePuy hip implant side effects between Aug. 21, 2013 and Jan. 31, 2015 were given an extended deadline.

As many as 1,400 additional DePuy ASR metal hip lawsuit plaintiffs may accept a settlement, adding $420 million to the total cost of settlements.

The DePuy hip implant settlement may not fit each plaintiff, and plaintiffs may be awarded different amounts depending on their case. Plaintiffs are also not required to accept the terms offered by Johnson and Johnson and can continue to pursue a DePuy hip lawsuit.

Terms of DePuy Hip Implant Settlement

Plaintiffs who wish to accept the settlement must have had their DePuy ASR metal hip implanted in the United States between Aug. 31, 2013 and Jan. 31, 2015. It was noted that only the ASR hip implant is covered in this settlement.

As with most settlements, a certain percentage of plaintiffs must accept the settlement in order for anyone to be paid.

Depuy ASR Metal-on-Metal Hip Implant

Depuy metal-on-metal hip implants have failed across the country. As the metal rubs on the metal, small particles are released into the bloodstream which can cause severe safety issues.

DePuy hip implant side effects may include:

  • Failure of the metal-on-metal hip implant requiring early replacement
  • Dislocated hip
  • Leaking of toxic substances into bloodstream from hip implant like chromium or cobalt
  • Cancer
  • Degenerative heart disease or Cardiomyopathy
  • Loss of bone strength or structure which can result in bone fractures
  • Tissue death for any tissue surrounding the hip implant
  • Non-cancerous tumors or pseudotumors around the hip implant
  • Cobalt poisoning
  • Metallosis or metal poisoning due to chromium or cobalt particles from the hip implant leaking into nearby tissue or the patient’s bloodstream

Depuy Hip Lawsuits

The DePuy ASR metal hip implant was recalled in 2010 by the U.S. Food and Drug Administration (FDA) after a large percentage of patients who used the DePuy metal-on-metal hip reportedly experienced adverse side effects.

A DePuy class action lawsuit investigation has been launched into Johnson & Johnson and DePuy and claims made by patients who suffered adverse hip implant side effects and hip revision surgery to remove the Depuy ASR metal hip implant.
