Another complaint has been added to the mounting lawsuits filed against transvaginal mesh product manufacturer C.R. Bard, alleging that it fraudulently concealed the dangers of vaginal sling devices and is in violation of consumer protection laws.
According thousands of lawsuits centralized in the Bard Transvaginal Mesh MDL, Bard negligently manufactured and sold defective and unreasonably dangerous products, withholding information from consumers and the medical community about the risk that transvaginal sling mesh may erode through the vagina, cause infections and other injuries.
Among the most recent vaginal sling lawsuits filed and joining the Bard Transvaginal Mesh MDL is that of a South Dakota woman. Plaintiff Christine H. contends that the Align TO Urethal Support System, a vaginal sling device, implanted surgically in May 2008 was negligently designed, thereby causing serious side effects such as mesh erosion, organ damage, chronic pain and other vaginal mesh complications.
Transvaginal Mesh Problems
Transvaginal Mesh and vaginal sling products are medical devices that are surgically implanted to treat Pelvic Organ Prolapse (POP) and/or Stress Urinary Incontinence (SUI). Transvaginal mesh surgery is supposed to strengthen the internal organs and prevent them from coming into contact with each other by implanting mesh tape or vaginal sling.
However, in response to the growing concern over transvaginal mesh problems, the FDA mandated healthcare professionals to further study the rates of transvaginal mesh failure, suggesting that these devices should be subject to more rigorous regulation and oversight.
A significant number of the adverse events reported to the FDA regarding pelvic mesh implants are due to mesh erosion or contraction.
Mesh erosion through the vaginal tissue can cause pain, bleeding and infection. In addition, most surgical mesh are made of polypropylene, a material that can shrink after being implanted, causing serious side effects and the POP or SUI condition to return.
Symptoms of vaginal mesh failure include:
- Urinary incontinence
- Abdominal pain
- Pelvic pain
- Pain during sexual intercourse
- Bleeding
The injuries that women are suffering from transvaginal mesh implants are severe and debilitating and could have been avoided had people had the proper information, according to vaginal mesh lawsuit plaintiffs. The edges of the mesh/sling cut through the skin after implantation causing infection and cutting into nearby structures sometimes puncturing the bladder, bowel, and uterus.
Additionally, petroleum-based synthetic material is particularly capable of causing infection because the material itself is a “breeding ground” for bacteria. Some of these infections spread through the whole body and lead to death.
Transvaginal Mesh Lawsuits
Lawsuits regarding Bard transvaginal mesh devices allege that a negligent design of the vaginal sling increases the risk that women may suffer severe complications, including physical pain and suffering, deformity and the need for additional corrective surgery. In many cases, Bard transvaginal mesh problems have required multiple surgeries to remove the vaginal sling.
Christine’s Vaginal Sling Lawsuit is Civil Action No. 2:15-CV-2118, and she joins the thousands of ongoing transvaginal mesh lawsuits against C.R. Bard, Inc. that remain to be resolved and are now consolidated pursuant to In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187, U.S. District Court, Southern District of West Virginia, Charleston Division.
