Navy asbestos lawsuitAn Arizona federal judge has refused to let nine manufacturers escape a wrongful death lawsuit filed by the family of a former U.S. navy worker who died of mesothelioma from on-the-job asbestos exposure, ruling the plaintiffs had adequately proved that the defendants’ products could have contributed to his death, and that they weren’t immune as military contractors.

Studies have shown that the U.S. Navy is one of the main workplaces where individuals may develop asbestos mesothelioma, a dangerous cancer in the lining of the lungs. Plaintiff George C. worked for the Navy from 1959 until 1994.

In 2012, George was diagnosed with asbestos mesothelioma in the right lung. He and his wife then filed an asbestos mesothelioma lawsuit. When George died in 2013, a claim of wrongful death was added to the suit.

The asbestos mesothelioma lawsuit claimed that the defendants were guilty of negligence and strict liabilities. According to the claim, “These theories are based on allegations that the manufactured and supplied products were designed defectively because the parts and equipment contained asbestos (design-defect claims) and did not have warning of asbestos-related health hazards (failure to warn claims).”

Asbestos Mesothelioma Lawsuit Progress

In a ruling issued Feb. 11, U.S. District Judge Susan R. Bolton stated that even before the claim of wrongful death the plaintiffs had enough evidence to establish causation against the nine defendants: Wm. Powell Company, CBS Corp., Warren Pumps LLC, Crane Co., IMO Industries Inc., Goodyear Tire & Rubber Co., Air & Liquid Systems Corp., Copes Vulcan Inc. and Flowserve US Inc.

Although the defendants attempted to claim immunity due to their role as government contractors, the judge claimed they could be held responsible. The defendants later attempted to be granted summary judgement. Judge Bolton stated that because the government did not require the defendants to include asbestos in their products that the responsibility still fell to the defendants.

Judge Bolton also left the plaintiffs able to claim punitive damages as well.
