Consumers who purchased the brand-name antibiotic Cipro—and later alleged the drug’s maker, Bayer Corp., conspired with other pharmaceutical manufacturers to bar cheaper, generic versions of Cipro off the American drug market—are receiving settlement checks in the mail from the Bayer Cipro class action settlement fund.
TCA viewers are reporting that valid claims have been paid out and Class Members are receiving checks for $25 or more from the Bayer Cipro class action settlement.
According to the Bayer Cipro settlement website, the settlement checks were first mailed out to eligible Class Members on Feb. 12, 2015, meaning more eligible consumers may be receiving checks within the next few days or weeks.
This Cipro class action settlement stems from one of two different class action lawsuits against Bayer and the other drug manufacturers allegedly involved in the Cipro antitrust scheme. Both Cipro class action lawsuits went to trial in California Superior Court. While this settlement resolves the antitrust claims against Bayer Corp., it does not resolve the claims raised in the related Cipro class action lawsuit filed against the other pharmaceutical manufacturers.
According to the Bayer Cipro class action complaints, Bayer, Barr Laboratories Inc. Hoechst Marion Rousse, Inc., Watson Pharmaceuticals Inc., and The Rugby Group Inc. allegedly violated federal and state antitrust statutes, as well as consumer protection laws, by agreeing to not compete with one another, with the end goal of barring cheaper, generic antibiotic version of Cipro off the pharmaceutical market.
Bayer denies all liability in this Bayer Cipro class action lawsuit, but agreed to settle the case in order to avoid the uncertainty of future litigation and mounting court costs.
A federal judge gave final approval for the proposed $74 million Bayer Cipro class action settlement in January 2014. As of last week, settlement checks have reportedly been mailed out to consumers.
Cipro Settlement Details
The Bayer Cipro class action settlement will provide relief to eligible Class Members that submitted a valid claim by March 31, 2014 [see our claim filing instructions here.]
Class Members of the Bayer Cipro settlement included all persons and entities that purchased the prescription antibiotic drug Cipro in California between January 8, 1997 and October 31, 2004.
The Class included both consumers and third-party payors.
The minimum amount of money a Class Member may receive form the Bayer Cipro settlement is $25, but some consumers have reported receiving more, depending on their claim.
