bladder cancerA Texas resident has filed an Actos lawsuit against Takeda Pharmaceuticals and Eli Lilly and Company for failing to adequately warn consumers and the medical community about serious and dangerous risks associated with taking the type-2 diabetes drug, specifically the possibility of developing bladder cancer.

Plaintiff Joe H. claims in his Actos bladder cancer lawsuit that he developed bladder cancer from taking the medication from March 2004 to August 2011 to treat his type-2 diabetes, saying that he was diagnosed with bladder cancer in December 2013 and underwent surgery to remove a tumor from his bladder.

Joe further alleges that the pharmaceutical companies willfully concealed their knowledge of Actos’ unreasonably dangerous risks in order to prevent any chances that U.S. Food and Drug Administration (FDA) approval of Actos would be delayed.

Actos Bladder Cancer Risk

Actos is a prescription medication manufactured and sold by Takeda Pharmaceuticals for treatment of type-2 diabetes. Studies suggests that side effects of Actos may cause users to face an increased risk of bladder cancer. The potential risk of Actos cancer problems is now being reviewed by health regulators in the United States and other countries throughout the world.

Some experts believe that an Actos recall should be issued or that much stronger warnings about the risk of bladder cancer from Actos should be added to the medication. Possible signs or symptoms of Actos bladder cancer may include:

  • Blood in the urine
  • Pain during urination
  • Frequent urination
  • Feeling the need to urinate without results

Although it appears that information about the risk of Actos complications have been known to the manufacturer for some time, inadequate warnings were allegedly provided to consumers and the medical community.

Actos Bladder Cancer Lawsuits

Several Actos bladder cancer lawsuits against Takeda have gone to trial, making similar allegations  that prior to the drug’s introduction to the market in 1999, Takeda possessed studies on laboratory animals showing an increased risk of bladder cancer when given Actos and allegedly failed to disclose these laboratory test results to health regulators.

Joe is seeking special and general relief as well as actual and punitive damages for Takeda’s violation of consumer protection laws by putting profits over public safety when it failed to warn consumers about the risk of bladder cancer associated with Actos. He has demanded a jury trial for this case.

The Actos Bladder Cancer Lawsuit is Case No. 6:14-cv-02627-RFD-PJH, and the Actos MDL is In re: Actos Product Liability Litigation, Case No. 6:11-md-02299, both in the U.S. District Court for the Western District of Louisiana.
