An Actos MDL (multidistrict litigation) now includes yet another plaintiff who allegedly developed Actos bladder cancer.

Plaintiff Charles V. and his wife filed the lawsuit in September against Takeda Pharmaceuticals. The plaintiffs alleged Takeda failed to warn them about potential Actos complications such as bladder cancer and heart damage and concealed Actos bladder cancer information from consumers and medical professionals.

The U.S. Food and Drug Administration (FDA) approved Actos in 1999 as a type-2 diabetes medication. Takeda allegedly failed to properly test the drug before it was approved although Actos bladder cancer was found in some pre-clinical studies, according to the Actos lawsuit.

The plaintiffs claimed Takeda “failed to completely disclose” the information it had about possible Actos bladder cancer risks or the fact that they failed to properly test the drug.

Actos use has been suspended and/or warned against around the world due to Actos complications found in a large number of users.

Actos MDL

According to the Actos bladder cancer lawsuit, Charles used Actos from 2006 to 2014. In June 2014, he was diagnosed with bladder cancer as an alleged result of long-term Actos use.

In the Actos lawsuit, Charles states that “the product warnings for Actos … were vague, incomplete or otherwise inadequate,” and that he never would have used the drug had he been aware of Actos bladder cancer risks.

Charles claims in the Actos bladder cancer lawsuit that Actos caused him to experience severe health side effects in addition to mental anguish, pain and suffering, loss of enjoyment of life, fear of future cancer, in addition to the need for “life long medical treatment, monitoring and/or medications.”

Charles and his wife accuse Takeda of negligence, failure to warn, defective design, breach of warranty, fraud and fraudulent concealment, and loss of consortium (loss of intimacy with a spouse).

This Actos Bladder Cancer MDL is In Re: Actos (pioglitazone) Product Liability Litigation,  MDL No. 6:11-md-2299, in the U.S. District Court for the Western District of Louisiana.
