DePuy hip implant lawsuitAccording to the recent reports, the election deadline for DePuy ASR hip lawsuits has been extended until Jan. 31.

This means that plaintiffs who have filed a metal-on-metal hip replacement lawsuit, but who have not yet undergone hip revision surgery, will have until the end of the month to decide whether or not to withdraw or continue with their metal hip implant lawsuits.

At the end of 2013, a DePuy ASR settlement agreement was reached between plaintiffs and DePuy Orthopaedic (a Johnson & Johnson subsidiary), resolving 8,000 DePuy metal hip replacement lawsuits for patients who were required to undergo hip revision surgery for a failed ASR metal-on-metal hip implant before Aug. 31, 2013.

Those plaintiffs who did not qualify for this DePuy ASR metal hip class action settlement were asked by the court to decide whether to continue with their individual hip implant lawsuits or to have their metal hip replacement lawsuits dismissed without prejudice.

Electing the latter option would allow these plaintiffs to refile their DePuy hip replacement lawsuit in the future, if and when they have a hip revision surgery.

U.S. District Judge David Katz filed a case management order in late December 2014 extending the election deadline to Jan. 31, a deadline which was agreed to by all parties involved in the centralized DePuy ASR lawsuits.

In this DePuy ASR hip replacement settlement, Johnson & Johnson’s orthopedic subsidiary has agreed to pay $3 billion to settle the ASR hip implant lawsuits. While this is great news for those consumers who have had metal hip implants and later required a hip revision surgery for an allegedly defective ASR metal hip implant, this still leaves several thousand metal hip implant lawsuits unresolved.

According to the judge’s order, non-revised plaintiffs who elect to have their individual ASR hip implant lawsuit dismissed will be allowed to refile their case within one year if they undergo an ASR hip revision surgery or within six months of an advisement by a medical professional that the risk to undergo hip revision surgery is too high.

The non-revised plaintiffs that elect to move forward with their hip implant lawsuit will have their metal on metal hip implant lawsuits undergo the discovery process.

ASR Metal Hip Implant Side Effects

According to several DePuy metal hip implant lawsuits, the ASR metal hip implant system’s high failure rate can be attributed to the design. The hip implant is shaped in such a way that makes the metal-on-metal hip implant product difficult to implant.

Surgeons have reported difficulties finding proper angle alignment during implantation. Additionally, when the ASR implant allegedly fails, small metal particles break off from the DePuy product, causing extreme pain to patients.

Other metal hip complications that may indicate a failed ASR metal hip implant include:

  • Hip failure
  • Unexplainable hip pain and discomfort
  • Random loosening of ASR Hip Implant
  • Inflammation in surrounding hip tissue from ASR metal

Hip revision surgery is usually required to remove and replace the DePuy ASR metal hip implant. Even after the defective hip implant is removed, a patient may continue to suffer severe pain and discomfort.
