New Balance toning shoe class action settlementGood news for everyone who filed a valid Claim Form for the New Balance toning shoe class action settlement: settlement payments were mailed yesterday, according to an update on the Settlement Administrator website.

The payments were mailed August 21, 2013, to eligible Class Members who purchased New Balance toning shoes between January 1, 2010 and August 29, 2012. The checks will arrive in five to seven business days.

The payments mark the end to a 2011 class action lawsuit (Carey v. New Balance Athletic Shoe Company Inc.) accusing New Balance of falsely advertising the health benefits of its TrueBalance toning shoes. Plaintiffs alleged that not only did the shoes fail to burn more calories or activate more muscles as advertised, but that they could actually lead to injury.

New Balance denied the allegations but agreed to refund consumers through a $2.3 million class action lawsuit settlement to resolve the litigation. Consumers who purchased New Balance Rock&Tone, TrueBalance, Aravon Ria, Aravon Riley and Aravon Quinn shoes during the Class Period had until February 25, 2013 to file a Claim Form. The amount of money Class Members will receive will be based on how many people filed valid claims.
