Unum disabiliy insurance problems

An Arkansas man has filed a disability insurance lawsuit against Unum Life Insurance Company alleging the company wrongfully denied long-term disability (LTD) benefits under his employer’s plan. Long-term disability benefits provide financial benefits to employees when they are unable to work due to a disability regardless of whether or not that illness or injury is work-related.

Unum insurance policyholder Andrew B. recently became well acquainted with the bad faith insurance practices Unum has become infamous for. This alleged red tape also serves as the foundation for the growing number of bad faith insurance lawsuits being filed against Unum Insurance. Andrew filed his own Unum bad faith insurance lawsuit on Dec. 30, 2014.

His former employer, MAPEI Corporation, contracted with Unum Insurance to provide long-term disability benefits to full-time employees. According to the Unum claim denial lawsuit, Andrew was unable to continue to work because of degenerative disc disease and was denied disability benefits from his Unum LTD policy. Despite providing overwhelming medical proof, including numerous opinions from his primary treating physician and from a spine and pain specialist, Unum Insurance denied Andrew’s long-term disability benefits claim, allegedly without legal justification.

Unum Bad Faith Insurance Practices

It may come as no surprise to some people who deal with companies like Unum that Unum is listed as the second-worst insurance company in the United States. Unum lawsuits alleging the company engages in bad faith insurance practices regarding denied disability claims have been filed against the company. In 2012, the American Association for Justice (AAJ) included Unum on its list of 10 worst insurance companies.

In California, according to the AAJ, approximately one in four claims for long-term care insurance was denied, resulting in an investigation by the California Department of Insurance. That investigation reportedly uncovered widespread fraud committed by Unum, including violations of state insurance regulations, use of phony medical reports to deny or underpay claims and investigations that were biased.

Tactics allegedly used by insurers to unreasonably delay or deny insurance claims include: arguing the policyholder had a pre-existing condition, even if that condition is not linked to the one being claimed; refusing to acknowledge certain disabilities; ignoring professional medical diagnosis or using biased experts; changing policies after a claim is filed; and claiming a person is not disabled and can work, despite a medical diagnosis from a professional.

Such tactics may be considered bad faith insurance practices, and policyholders whose claims have been improperly or unreasonablly denied or delayed may be eligible to file a disability insurance lawsuit against the insurance company.

Andrew is seeking to recover payment of all LTD benefits withheld pursuant to section 502(a) of the Employee Retirement Income Security Act of 1974 (ERISA) with interest and continued payment of LTD benefits as well as attorneys’ fees and costs.

The Unum Bad Faith Insurance Lawsuit is Case No. 4:14-cv-00760-BSM, in the U.S. District Court for the Eastern District of Arkansas, Western Division.
