xarelto

A Xarelto lawsuit was filed against Bayer, alleging that the blood thinner that was supposed to prevent blood clots after surgery caused severe bleeding.

This is one of many Xarelto bleeding lawsuits that has been filed claiming that the drug manufacturers misled and failed to warn its patients about Xarelto bleeding side effects.

Plaintiff Patsy S. used Xarelto from July 2013 to November 2013. On Nov. 4, 2013, Patsy allegedly experienced severe Xarelto bleeding.

According to the Xarelto lawsuit, Janssen and Bayer are accused of misrepresenting Xarelto side effects and health risks to the medical and healthcare community. The defendants also allegedly failed to adequately test Xarelto in the first place. The defendant’s actions allegedly led to the severe, life-threatening bleeding experienced by the plaintiff.

Xarelto side effects allegedly caused Patsy to experience physical pain, mental anguish, and a diminished enjoyment of life, “as well as the need for lifelong medical treatment, monitoring and/or medication, and fear of developing [certain] health consequences,” the Xarelto lawsuit states.

Xarelto was approved two years before Patsy began to use the drug to reduce the risk of stroke and systemic embolism in patients with non-valvular atrial fibrillation. It may also be used to prevent blood clots in patients who have just underwent surgery.

Because of the actions of the defendants, Patsy was allegedly “severely and permanently injured and will require more constant and continuous medical monitoring and treatment,” according to the Xarelto lawsuit.

Xarelto

Xarelto was introduced to the market as an alternative to warfarin, which requires additional blood tests and monitoring after use. However, there is an antidote to warfarin in the case of uncontrolled bleeding. There is no Xarelto antidote to slow the bleeding should it occur, as it allegedly has.

Xarelto was heavily promoted across the country, with over $11 million spent in 2013 on advertising in journals alone. The U.S. Food and Drug Administration (FDA) required Bayer and Janssen to cease promoting their materials claiming that, “the print ad is false or misleading because it minimizes the risks associated with Xarelto,” says the Xarelto lawsuit.

Thousands of adverse side effect reports have been filed with the FDA due to Xarelto bleeding complications.

Xarelto Lawsuits

The Xarelto lawsuit charges Bayer and Janssen with negligence, product liability, breach of warranty, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, and fraud and deceit.

The number of Xarelto lawsuits has continued to grow as more patients experience Xarelto bleeding side effects. Various studies have found increased bleeding risks in Xarelto users, and several FDA adverse event reports include severe bleeding and even death.

Patsy is seeking compensatory, punitive, and exemplary damages in addition to attorney fees for the harm caused by alleged Xarelto side effects.

This Xarelto Bleeding Lawsuit is Case No. 1:14-cv-06278, in the U.S. District Court for the Eastern District of New York.
