Washington Consumers Can Claim Tax Refund from Cingular/AT&T

Cingular/AT&T tax refundCingular Wireless (now known as AT&T Mobility) has been accused of overbilling Washington State customers over $2 million by adding an illegal surcharge to its monthly bills. A class action lawsuit over the matter fought its way through court for seven years until it was forced into arbitration, but customers can still claim a tax refund from Cingular through a claims process similar to a class action settlement recovery.

If you subscribed to Cingular in Washington State anytime between 2002 and 2006, you can submit a claim for the Cingular tax refund at www.IllegalPhoneTaxRefund.com. There is no deadline, and the estimated refund you can expect to see will average $25. Some customers, however, may see a refund of several hundred dollars, according to one of the attorneys who represented the plaintiffs in the class action lawsuit.


Daniel F. Johnson, from the law firm Breskin, Johnson Townsend PLLC, told Top Class Actions that they will continue to hold Cingular/AT&T responsible for paying back its customers despite a 2011 Supreme Court decision that forced the Cingular tax class action lawsuit into arbitration.

“As the court rulings posted on our site show, we litigated this statewide class action almost to judgment, obtaining a ruling for the plaintiffs [that confirmed the surcharge was illegal],” Johnson says.

After the ruling in favor of the plaintiffs, AT&T used the Supreme Court Conception ruling to force customers into individual arbitration, which means each customer now has to make his or her own claim for the refund. This is usually a daunting task for consumers (which is why class action settlements are the favored form of recovery in these types of cases), but Johnson and his firm have set up an easy-to-fill-out form online to help customers recover the money they’re owed.

“We are trying to facilitate recovery for as many Class Members as possible,” says Johnson, adding that the recoveries will range from tens to probably hundreds of dollars per Class Member. “We hope a large number of people who subscribed to Cingular in Washington State will join us and make AT&T pay for its illegal billing practice.”

Johnson says there is no deadline to file a claim for the Cingular tax refund, but that the statute of limitations may be running out soon.

There is no cost to consumers to have Breskin, Johnson Townsend make their claim for them – the firm will demand fees from AT&T separately from the consumers’ damages under the Washington Consumer Protection Act.
