MyTechHelpA federal class action lawsuit has been filed against MyTechHelp LLC, alleging that the company engages in fraudulent behavior by offering technical support to get customers’ bank account information, and then repeatedly takes money out from users’ bank accounts.

Lead plaintiff Kelly Guerra alleges in the class action lawsuit that MyTechHelp markets itself as a technical support for electronic devices. Customers frequently believe that they have contacted the device manufacturer for technical support. However, Guerra claims that MyTechHelp is unaffiliated with manufacturers and unqualified to provide technical support.

“Over the telephone, defendant requests the consumer’s personal debit/credit account information for payment of the technical support service,” the MyTechHelp class action lawsuit states. “After the consumer provides defendant with their debit/credit card number, defendant initiates an unauthorized recurring charge to the unknowing consumer’s account.”

Guerra claims that she had contacted MyTechHelp to seek assistance with locating her lost iPhone. At the time, she believed she was contacting Apple’s technical support department. During her phone conversation, she agreed to pay $69.99 to use MyTechHelp’s equipment to locate her iPhone. According to the class action lawsuit: “At no time during the telephone conversation did the salesperson explain to plaintiff that defendant was not Apple, and was in fact not in any way affiliated with Apple.”

During the phone conversation, the representative did not request permission to initiate recurring charges to Guerra’s bank account. Guerra claims that she never agreed to purchase a “tech support plan” for a recurring payment of $19.99 each month.

According to disgruntled Internet users, many individuals find out about MyTechHelp when they perform an Internet search for tech support for their particular device. Because MyTechHelp is listed near the top of search results, they click the link and visit what appears to be a website that is affiliated with the major computer and cell phone manufacturers.

When they call the number, the tech support person claims to be affiliated with Apple and agrees to help troubleshoot the problem. The MyTechHelp representative claims that the issue is not covered by the product warranty, and asks for credit or debit card information in order to complete the requested service. The company will charge for a one-time service but then withdraws $9.99 each month from the customer’s account.

The Better Business Bureau’s website indicates that MyTechHelp’s BBB accreditation was revoked in April 2013 because it failed to maintain the minimum BBB rating.

Putative members of the class action lawsuit include all U.S. residents who had a debit or credit card that was subject to unauthorized recurring payments by MyTechHelp. Guerra is seeking an injunction and damages for fraud, unjust enrichment, deceptive trade, consumer fraud, violations of the Missouri Merchandising Practices Act and violations of the Electronic Funds Transfer Act.

The MyTechHelp Fraud Class Action Lawsuit case is Kelly Guerra v. MyTechHelp LLC, Case No. 13-cv-01227, U.S. District Court, Missouri Eastern District Court, St. Louis

Guerra is represented by Thomas Schwartz of Holloran, White, Schwartz & Gaertner.

I have filed a complaint against MyTech Help.com or techzilla-whatever they are calling themselves these days. I authorized them to fix my MacBook Pro laptop thinking they were authorized Apple technicians. THEY ARE NOT!! When I got my laptop back from them after waiting over a month, the hard drive they installed crashed. I took my laptop to an authorized Apple tech., which I should have done in the first place in retrospect, and they said the hard drive was causing my computer to crash again. In addition, the MyTech Help “techs” installed a top case that was not necessary and Ram plus a repair plan. the whole bill came to an embarrassing (for me) $1021.99! They so misrepresented themselves and misled me, I filed a complaint against them with the BBB and Consumer Protection Agency. I am hoping to get some restitution with my complaint from this fraudulent company. Do not use them under any circumstances!

  6. Derek Kelly says:

They are a company that make you believe they are working on the behalf of apple. I just wanted troubleshoot help because I couldn’t turn my computer on, and then they told me my computer battery can explode! They ask you to pay 200$ and then they bill you every month. Their company URL is apple.mytechhelp.com and if you search apple tech support on google, they are on top of the list. Can you see why I thought they were apple? Don’t get scammed like I did!

  8. hadar says:

They are taking $10 from my account in the past 1 year and a half every month without my permission! I called them 2 months ago and asked who gave them authorization to charge my account and they didnt give me a clear answer. When I asked to get my money back they said they will call me back and never did! I called today again and they kept me 20 minutes on hold, transferring me from one rep. to another. After 40 minutes I got to talk to the manager and asked for the money they took from my account without my permission and he said that there is nothing he can do! I called again and asked to talk to a supervisor, they kept me 20 minutes on hold and then they disconnected the call!! I am so angry and I hope you win the lawsuit!

  9. Andrea W. says:

So glad to hear this! Not only do they do this to people, but they also infringe on trademarks of other company’s. I have lost track of how many pissed off people have called my husbands company thinking they are MyTechHelp. He has even had is own clients calling him asking him about this company. He has his own legal actions currently going against MyTechHelp and I sure the hell hope with this class action lawsuit, his legal proceedings are a resounding success.

  10. Andy G says:

Please win this lawsuit. I cannot believe that this company is still in existence. It is an embarrassment to the United States of America and has stolen money from thousands of people including myself! Shame on you MyTechHelp.
