LiveDeal Activator Check Class Action Settlement Approved

LiveDeal Inc. announced that the company recently finalized a class action lawsuit settlement related to its “Activator Check” promotion, which allegedly tricked Yellowpage customers into enrolling into an advertising program. LiveDeal does business as YP.com, YP.net and Yellowpage.net.
LiveDeal President and CEO Jon Isaac said that while the company believes the allegations in the class action lawsuit were without merit, “we’re thrilled to have reached this favorable settlement.”
The LiveDeal settlement resolves a five-year-old class action lawsuit (Global Education Services Inc. v. LiveDeal Inc., et al.) that accused the defendants of running a promotional scheme that sent unsolicited “Activator Checks” to consumers in Washington State that did not adequately disclose that cashing the checks would result in the purchase of the company’s advertising services.
Residents of Washington State who cashed an Activator Check after June 6, 2004 will receive $70 from the class action settlement if they submitted a valid Claim Form by the April 1, 2013 deadline. [We told you how to file a claim for the class action settlement in March.
A federal judge granted final approval to the LiveDeal class action lawsuit settlement on May 27, 2013.
Of the timely 185 claims that were submitted, 169 appear to have been submitted by persons who are not Class Members, according to court documents. These persons will receive a letter from the Settlement Administrator requesting that they submit proof of their Class membership within 45 days after the letter is mailed.
