Registration Deadline for Chinese Drywall Settlement Claims is June 24

By Matt O’Donnell

Chinese drywall settlementConsumers looking to participate in one of the Chinese drywall class action lawsuit settlements must complete a Registration Form before they can submit a Claim Form, according to a recent ruling by the judge presiding over the MDL.

At a Status Conference held yesterday, the Court discussed a May 24 order by U.S. District Judge Eldon E. Fallon requiring all who wish to participate in a Chinese drywall settlement to register their claim before they will be allowed to file a claim. Judge Fallon extended the registration deadline to June 24, 2013, and established August 26, 2013 as the new deadline to file all claims in the Chinese Drywall Settlement Program.

So far five class action settlements have been approved in the Chinese drywall MDL, which will resolve claims that Chinese drywall caused property damage and personal injuries by emitting noxious sulfuric fumes. The five class action settlements are with:

(1) In Ex – Interior Exterior Building Supply, LP and its insurers;
(2) Banner – the Banner entities and their insurers;
(3) L&W – the L&W Supply Corporation and USG Corporation;
(4) Knauf Defendants; and
(5) The Global Settlement — 700 additional Participating Builders, Suppliers, and Installers and their Participating Insurers.

Four additional settlements, which mainly affect residents of Virginia, have not yet received final approval from the Court. If the Court grants final approval of these settlements, eligible Class Members will be given an opportunity to submit a Claim Form to potentially receive benefits. Top Class Actions will update our readers on how to file a claim for the Virginia Chinese drywall settlements when the information becomes available.

The Court reiterated at the Status Conference yesterday that to make a claim under the Chinese Drywall Settlement Program with the five defendants above, you must complete, sign, and submit a Registration Form to the Claims Administrator on or before June 24, 2013. If you do not register on or before June 24, 2013, you will not be permitted to pursue a Chinese Drywall claim. You must complete a Registration Form before you can submit a Claim Form.

You may register your claim by going to https://www3.browngreer.com/drywall. If you do not have an attorney, you can create a username and password, login, and complete the Registration Form on your own.  If you are a law firm and wish to register claimants, email Chinesedrywallregistration@browngreer.com to request login credentials.

After you register, you may submit a Claim Form online or download a hard copy submission at https://www3.browngreer.com/drywall. If you have already registered and wish to file a claim, login and follow the instructions on the Portal to complete and submit a claim. It will be far easier for anyone filing a claim to use the online Claim Form filing process, rather than file hard copy Claim Forms.

If you wish to download a paper copy of the Registration or Claim Forms, go to https://www3.browngreer.com/Drywall/Un-Secure/PaperForms.aspx.

The deadline to file a claim is August 26, 2013.
