Axiron lawsuit

A recent lawsuit alleges that the testosterone gel product Axiron is unsafe and consumers who use Axiron are at a significant risk for blood clots or cardiovascular impairments

Kentucky resident Steven Maupin filed the Axiron lawsuit against Eli Lilly and Company for allegedly failing to adequately inform consumers and the medical community about the increased risk of heart attacks associated with using Axiron and other testosterone gel products.

Eli Lilly manufactures Axiron as a treatment for low testosterone or “Low T”. The Food and Drug Administration (FDA) approved Axiron to treat adult males who have the medical condition hypogonadism (low or no testosterone) in conjunction with an associated medical condition such as failure of the testicles to produce testosterone, genetic problems, or chemotherapy.

The Axiron lawsuit  alleges that Eli Lilly purposely deceived the medical community and consumers into believing that Axiron testosterone gel was a safe and effective treatment for low testosterone while withholding facts about life-threatening health risks associated with the use of the drug.

Maupin claims in the Axiron lawsuit  that he suffered a life-threatening heart attack resulting from taking Axiron during the period of April 2012 through July 2012 to treat his low testosterone. His case joins dozens of other testosterone gel lawsuits accusing manufacturers of downplaying the risks of testosterone side effects.

What is Axiron?

Axiron is a hydroalcholic gel that is applied to the underarms and enters the body through transdermal absorption which can increase serum levels of testosterone. Axiron is a testosterone replacement therapy used to treat men with very low levels of testosterone due to a serious medical condition (hypogonadism, chemotherapy, missing or damaged testicles, and more).

Axiron treats low levels of testosterone, a hormone essential to male growth, sexual health, and masculine characteristics. Axiron is only approved to treat low testosterone in conjunction with one of the following serious medical conditions:

  • Hypogonadism
  • Genetic problems with testosterone production
  • Chemotherapy
  • Problems with brain (hypothalmus or pituitary) that control testosterone
  • Missing or damaged testicles

Does Axiron Increase The Risk Of Heart Attack?

Numerous medical studies have uncovered a troubling link between Axiron and heart attacks. Some key study findings used in Axiron heart attack lawsuits include:

  • A 2014 study published in PLoS One reported that testosterone replacement therapy doubles risk of heart attack for men over 65, and triples risk for men under 65 with pre-existing heart disease.
  • A study published in the 2013 Journal of the American Medical Association found testosterone was linked to a 30% increased risk of heart attack and stroke in first 90 days of treatment.
  • A 2010 study by the New England Journal of Medicine was discontinued prematurely after an exceedingly high number of men in the testosterone group suffered adverse effects.

Maupin is seeking all general, equitable relief, and special damages for Eli Lilly’s alleged fraudulent misrepresentation of the side effects of Axiron and all reasonable court costs. He has demanded a jury trial for this case.

The Axiron Heart Attack Lawsuit is Steven Maupin v. Eli Lilly and Company, et al., Case No. 1:14-cv-01669, U.S. District Court, Southern District of Indiana.

In general, testosterone product lawsuits are filed individually by each plaintiff and are not class actions.
