A widow from Wisconsin has filed an Actos bladder cancer lawsuit against Takeda Pharmaceuticals and related companies, alleging that the drug was the cause of her late husband’s fatal cancer.

The Actos cancer lawsuit was filled by plaintiff Sharyn B. on behalf of herself and her deceased husband James. Per the Actos bladder cancer lawsuit, James took Actos from June of 2003 and July of 2013. In April of 2014, he was diagnosed with bladder cancer, which ultimately took his life in June 2014.

Actos is a drug designed to treat type-2 diabetes. Type-2 diabetes is a chronic disease that causes a patient to loose control of the amount of sugar in their blood. With type-2 diabetes, glucose can build to toxic levels in the blood, causing damage throughout the body like kidney damage, heart disease, and even gangrene in the extremities. Drugs like Actos are designed to help diabetics control their blood sugar but studies have suggested, and Actos lawsuits have alleged, that the drug can cause bladder cancer.

Sharyn’s Actos bladder cancer lawsuit holds that Actos caused her husband’s cancer. Her lawsuits cites a study published in the medical journal The Lancet that found as early as 2005 that patients taking Actos had an increased risk of developing bladder cancer. A 2010 FDA Safety Announcement stated that the Agency was reviewing data from a 10-year epidemiological study to explore the possible connection between Actos and bladder cancer.

The FDA’s study found dose-dependence, an indication that the drug may be linked to the disease. This means that patients taking higher doses of Actos experienced greater rates of bladder cancer. In medicine, dose dependence is a major tip off that a connection between a disease and a risk factor is not mere coincidence.

Additionally, Sharyn’s Actos bladder cancer lawsuit holds that Takeda did not act quickly in the face of building evidence that the drug could cause bladder cancer. Despite these studies dating back to 2005, and the banning of Actos in several foreign countries, the drug remains on the market in America.

In 2013, regulatory agencies in Germany, France, and the United States either censured, advised against, or outright banned the use of Actos to treat type-2 diabetes in light of evidence that the drug increases the risk of bladder cancer in long-term users.

Sharyn’s Actos bladder cancer lawsuit is Case No. 6:14-cv-02603-RFD-PJH. It joins the larger Actos MDL In RE: Actos (Pioglitazone) Products Liablity Litigation, MDL No. 2299, filed in the United States District Court for the Western District of Louisiana.

In general, Actos bladder cancer lawsuits are filed individually by each plaintiff and are not class actions.
