A testosterone product lawsuit alleges a New Jersey man suffered life-threatening complications after taking AndroGel and Depo-Testosterone.
The testerone product lawsuit was filed this month by plaintiff Thomas Burnejko against AbbVie Incorporated and several related companies. He was prescribed AndroGel and Depo-Testosterone, low-T drugs manufactured by the defendants, when he was about 50 years old, the testosterone lawsuit said. After taking the drugs, he developed a serious myocardial infarction, which his AndroGel lawsuit alleges was caused by these drugs.
The AndroGel lawsuit holds that testosterone products like AndroGel and Depo-Testosterone promote the risk of serious blood clots. The AndroGel lawsuit cites clinical trials for AndroGel that found 9 percent of patients experienced changes in blood chemistry that could promote abnormal blood clotting.
While blood clotting is a part of the normal healing process, when the process misfires, blood clots can form inside blood vessels and block the blood supply to critical organs and tissues. Subsequent epidemiological research found that men taking Low-T drugs had an increased risk of stroke, pulmonary embolism, and other medical problems associated with errant blood clots. Myocardial infarctions like the one that Burnejko experienced are a type of heart attack caused by a blood clot lodging in the blood vessels that feed the heart.
The AndroGel lawsuit goes on to state that the drug makers that produce AndroGel and Depo-Testosterone have “created” demand for these drugs. These drugs are designed to increase testosterone levels in aging males suffering from Low-T, or declining testosterone. However, the AndroGel lawsuit states “low testosterone is not a disease recognized by the medical community. Instead, it is a normal result of the aging process experienced by the majority of males.” The AndroGel lawsuit characterizes the aggressive promotion of drugs like AndroGel and Depo-Testosterone as “disease mongering,” drumming up concerns of a disease in order to sell drugs to treat it. According to the AndroGel lawsuit, AndroGel alone has generated $1.37 billion in sales per year since it was released.
The AndroGel Lawsuit is Thomas Burnejko, et al., v. AbbVie Inc., et al., Case No. 1:14-cv-6811, within the testosterone products MDL In Re: AndroGel Products Liability Litigation, MDL No. 2545, in the U.S. District Court for the Northern District of Illinois.
In general, testosterone product lawsuits are filed individually by each plaintiff and are not class actions.
