Electrolux class action lawsuitOn September 11, U.S. District Court Judge Christina A. Snyder granted final approval for the proposed settlement in the Electrolux dryer fire class action lawsuit that had accused Electrolux Home Products Inc. of selling dryers that contained defects that caused them to catch fire due to lint buildup.

The class action lawsuit alleged Electrolux breached warranties, was negligent, violated consumer protection laws and unlawfully profited from the sale of the dryers. Electrolux allegedly sold the defective dryers under the following brands: Frigidaire, White Westinghouse, Kelvinator, Gibson, Tappan, Crosley, and Kenmore. The dryers at issue in the class action lawsuit were manufactured by Electrolux in Webster City, Iowa between Jan. 1, 2002 and Dec. 31, 2011.

In her order approving the Electrolux class action settlement, Judge Snyder approved the following benefits for eligible Class Members; “1) A Cash rebate or online voucher code worth up to $350 off the purchase of a new Frigidaire – or Electrolux-brand home appliance or product; and/or 2) A free dryer cleaning service for eligible Dryers; and/or 3) Up to $1,300 for out-of-pocket expenses due to a fire in a Dryer,” according to the settlement website.

The Class includes “all persons in the United States who purchased or currently own a new Frigidaire, White Westinghouse, Kelvinator, Gibson, Tappan, Crosley or Kenmore brand ball-hitch freestanding clothes dryer manufactured by Electrolux between Jan. 1, 2002 and Dec. 31, 2011” as well as “two Subclasses, consisting of Class Members (1) who have experienced a dryer fire and (2) who experience a dryer fire in the future.” Electrolux has also agreed to send notices to Class Members informing them that lint can build up inside their dryers and that dryers should be cleaned by an authorized service professional at least every 18 months.

The Electrolux Dryer Fire class action lawsuit alleged that Electrolux-designed and manufactured “ball-hitch” clothes dryers have “uniform and dangerous defects … that cause these dryers to catch fire, fail, char clothes, and spread any fire outside the dryers, thereby damaging property and creating a serious safety risk to consumers and the public.” The lead plaintiffs alleged that the dryers were defective because they where designed in a way that “cause[d] lint to accumulate behind the drum in direct proximity to the heat source.” This design defect “can ignite and travel into the drum” and beyond, continued the class action lawsuit.

Under the terms of the dryer fire class action settlement, Electrolux admits no negligence or other wrong doing and “shall be released from any and all Released Claims any Class Member had, has, or may have in the future, except for those individuals who timely excluded themselves from the Settlement.”

The deadline to file a claim for the Electrolux dryer fire class action settlement is Dec. 15, 2014, though the filing period remains open until 2022 for the reimbursement of future dryer fires. Click here or visit www.DryerSettlement.com for detailed instructions on how to file a claim.

The plaintiffs are represented by class action lawyers from Wexler Wallace LLP, Kreindler & Kreindler LLP, Hansen Reynolds Dickinson Crueger LLC and Greg Coleman Law PC.

After calling the # provide on the certificate for cleaning of my Dryer the appointment was set with A-1 appliance and air condition repair on 7/7 between 12-5pm, work order #8804214. A technician arrived at 9:00am on the morning of the 7th and when I showned him the certificate he told me they donot do cleaning. Why would someone come out and decide they dont do the work when the work order explains the details of the job. This doesnt make sense.
